Timothy P. Blanchard is a partner in the law firm of McDermott Will & Emery LLP and is based in the Firm's Los Angeles office. A member of the Firm's Health Department, Tim focuses on health care regulatory issues, including Medicare and Medicaid coverage, billing and payment; fraud and abuse audits and investigations and health care compliance programs; and clinical trials billing and compliance, HIPAA privacy, certification and licensing, and utilization review.
Tim frequently speaks and writes on health care reimbursement, regulatory and false claims issues. Tim has testified before the House Committee on Small Business regarding Medicare coverage and payment policy issues and has addressed Government Accountability Office staff regarding Medicare and Medicaid medical necessity policy issues. He is the author of several leading articles on medical necessity policy, including: "Medicare Medical Necessity Determinations Revisited: Abuse of Discretion and Abuse of Process in the War Against Medicare Fraud and Abuse," 43 ST. LOUIS U.L.J. 91 (1999) and "Medical Necessity Denials As A Medicare Part B Cost-Containment Strategy: Two Wrongs Don't Make It Right Or Rational," 34 ST. LOUIS U.L.J. 939 (1990). Tim is the Co-Editor of A Guide To Complying With Stark Physician Self-Referral Rules (Atlantic Information Services) and has also contributed chapters to the Health Law Practice Guide (Thompson/West) (ambulatory services) and the Health Law Handbook (West) (healthcare coding compliance, and Medicare outpatient prospective payment system compliance).
Tim is active in the American Health Lawyers Association and has just completed service on its Board of Directors (2001-2007). He also chairs AHLA's Annual Institute on Medicare and Medicaid Payment Issues. Tim is a Fellow of the Healthcare Financial Management Association, a member of the editorial review board of Healthcare Financial Management, a member of the editorial Advisory Boards of CCH Healthcare Compliance and CCH Health Care, a member of the Editorial Advisory Board for United States Health Care Laws & Rules 2006-2007 (AHLA) and a member of the Legal Advisory Committee of the American Academy of Professional Coders.
Tim is ranked as a leading lawyer in health law in the latest editions of both Chambers USA, Expert Guides to the Leading US lawyers - Best of the Best USA and Southern California Super Lawyers, and is included in Nightingale's Healthcare News' 2006 Outstanding Fraud and Compliance Lawyers.
Tim was honored by Public Counsel Law Center, Los Angeles, as Outstanding Advocate in 2001 and as Advocate of the Year in 2002 for his pro bono work in its Community Development Project.
