Seema Misra is a litigation partner who represents clients in a wide variety of business disputes, before state and federal courts, as well as arbitral tribunals. She has particular expertise in the areas of commercial disputes, insolvency related litigation, and insurance and reinsurance disputes.
Ms. Misra’s commercial litigation experience has involved prosecuting and defending a wide variety of claims, relating to commercial contracts, lender liability, fraud and other business torts. She has participated in many complex multi-jurisdictional disputes, including parallel U.S. and foreign proceedings. Ms. Misra has also advised companies, liquidators and creditors in litigation arising out of the implementation of foreign and multi-jurisdictional insolvency proceedings, and has obtained protection pursuant to section 304 of the U.S. Bankruptcy Code for clients.
In the area of insurance, Ms. Misra has represented and counseled clients with respect to issues arising out of directors’ and officers’ insurance, employment-related coverage claims and property claims. She has appeared in courts and before arbitration panels for reinsurance disputes arising out of facultative certificates, excess of loss and quota share reinsurance treaties, MGA Agreements, and other contracts relating to reinsurance relationships.
