William Kettlewell Biography :

William H. Kettlewell is a partner at Dwyer & Collora specializing in the area of criminal defense and complex civil litigation in federal and state courts.

Mr. Kettlewell’s practice focuses primarily on white collar criminal defense and complex civil litigation in federal and state courts. His work includes the full range of representation of clients from internal corporate investigations to grand jury proceedings as well as civil and criminal trials and appeals.

Mr. Kettlewell has represented individuals and corporations charged with state and federal crimes involving violations of health care fraud and abuse laws, Food and Drug administration laws, banking, procurement, anti-trust and environmental laws.

Mr. Kettlewell served as a state and federal prosecutor for 11 years before joining Dwyer & Collora, LLP, in 1988. As an Assistant US Attorney, he was Chief of the President’s Organized Crime and Drug Task Force for New England and later Chief of the Criminal Division.

Mr. Kettlewell specializes in the area of criminal defense and complex civil litigation in federal and state courts. In the recent past, Mr. Kettlewell has defended FDA health care, anti-trust, bank, environmental, and procurement fraud cases.

United States v. McKenzie et al. Docket No. 01-CR-10350 (DPW) (July 2004) (secured an acquittal in U.S. District Court in Boston of a pharmaceutical executive from TAP Pharmaceuticals charged, along with 11 other defendants, with conspiracy to violate the anti-kickback statute)

United States v. Nippon Paper, Inc., 109 F.2d (1st Cir. 1997); 17 F.Supp. 2d 38 (D. Mass. 1998); 628 F. Supp. 2d 173 (D. MA 1999) (counsel together with O’Melveny & Myers on criminal price-fixing prosecution; obtained R29(c) acquittal after a mistrial)

United States v. Rafael (D. MA 1995) (lead counsel in criminal price-fixing case involving fishing industry in Massachusetts; acquittal after jury trial)

United States v. Cvinar, (D. Mass. 1996) (United States v. Prigmore, 243 F.3d, (1st Cir. 2001) previously reported as United States v. Leichter, 160 F.3d 33 (1st Cir. 1998)) (co-lead counsel in defense of alleged FDA fraud concerning angioplasty catheters; conviction reversed on appeal to First Circuit)

United States v. Saybolt, Inc. (D. Mass. 1998) (successfully negotiated settlement with Department of Justice, U.S. Attorney’s office and E.P.A. concerning clear air, Foreign Corrupt Practice Act and related offenses)

United States v. Shaw, 113 F.Supp. 2nd 152, 2000, U.S. District Lexis 13687 (misjoinder), 106 F. Supp. 2nd 103, 2000 District Lexis 9347 (Statute of Limitations) (health care fraud prosecution of former Division President of National Medical Care, Inc.)
