William James has practiced at Kenyon & Kenyon since 1996. He focuses primarily on patent litigation, and he has worked on litigations involving chemical, pharmaceutical, medical, mechanical and biotechnology patents. Recently his practice has focused on pharmaceutical and chemical patent litigation arising from the filing of Abbreviated New Drug Applications (ANDA's) under the Hatch-Waxman act. For example, Dr. James recently worked on Merck & Co. v. Teva Pharmaceuticals USA (D. Del.), Aventis Pharmaceuticals et al. v. Impax Laboratories, Inc., (D. N.J.), and Glaxo Group et al. v. Mayne Pharma (USA) Inc., (D. N.J.), which involved the osteoporosis medication alendronate, the antihistamine fexofenadine, and the anti-nausea agent ondansetron. Other litigation experience includes Cordant Technologies v. Alliant Techsystems (D. Del.), a case involving rocket motor insulations, and Purdue Pharma v. Faulding Pharmaceutical Co. (D. Del.), a case involving long acting morphine formulations. In both of the latter cases Kenyon secured victories for its clients when the patents at issue were declared invalid. Dr. James's patent litigation experience has included all aspects of the litigation process, and in addition he has participated in several appeals to the U.S. Court of Appeals for the Federal Circuit.
Dr. James also counsels clients in various technical fields on validity, enforceability and infringement issues, including start-up companies in the biotech and nanotechnology fields. In addition, Dr. James participates in the prosecution of patent applications on biotechnology, chemical, medical product and mechanical inventions.
Dr. James is a member of the American Bar Association and the New York Intellectual Property Law Association.
