Description of Practice:
Tim is a litigation partner in our Los Angeles office, where his practice focuses on real estate disputes, construction litigation, and commercial litigation. As the senior litigator in the Allen Matkins' lease dispute practice, Tim has extensive experience representing both landlords and tenants in all types of lease disputes, including those related to retail and commercial leases, and disputes involving unlawful detainer, fraud, and breach of lease agreements. His work has included over 100 landlord-tenant matters within a recent one-year period. He has tried or arbitrated lease disputes involving noncompetition provisions, exercise of option disputes and continuous operating covenants, as well as other breach of lease, failure to pay rent, and unlawful detainer matters.
Additionally, Tim represents owners, contractors, lenders, architects, engineers, and subcontractors in general construction litigation. From representing a hotel development in a multi-forum (state court, bankruptcy court and AAA arbitration) construction case involving more than 50 parties, a 120-day plus arbitration and two 10-day court trials, to representing owners, contractors, architects and engineers in all manner of construction defect, breach of contract, mechanics liens, design and delay claims, he has over 25 years of experience in handling these multi-party, multi-issue complex cases to successful resolutions on behalf of his clients.
Tim also handles commercial disputes relating to breach of partnership agreements, fiduciary duty, and misappropriation of funds. He represents title insurers or their insureds in litigation ranging from lien priority, easement, lot line, and encroachment issues to marketability of title or other title defect cases.
In addition to his full-time litigation practice, Tim is the firm's Operating Partner in the Los Angeles office. Tim was admitted to the State Bar of California in 1979 and is a member of the American Bar Association. He has lectured frequently to Bar and Business organizations. He is a past Chair of the Southern California Litigation Subsection of the Real Property Section of the California State Bar.
Educational History:
Tim received his J.D. from the University of California, Hastings College of the Law in 1979 where he was Order of the Coif and a member of the Thurston Society. He received his B.A., cum laude, from the University of California, Los Angeles in 1976. |
