Thomas Schehr Biography :

Mr. Schehr's commercial litigation practice focuses on business disputes, oil and gas matters, lender liability disputes, and intellectual property litigation. He has experience representing a broad range of clients in complex commercial litigation. He has tried cases in federal and state courts and in arbitration, and he has been retained as an arbitrator. Before joining Dykema, Mr. Schehr was a law clerk to the Honorable Avern Cohn, United States District Judge for the Eastern District of Michigan, from 1997 to 1999.

Experience

Trial counsel for global energy company in complex litigation concerning a fractionator of natural gas liquids. The arbitration panel issued an award of $13.4 million in favor of Mr. Schehr's client.

Represented motion picture studio in contract dispute arising out of the production of the "8 Mile" film in Detroit. Mr. Schehr was lead trial counsel and obtained judgment in favor of his client after a bench trial.

Represented oil company in breach of contract and real estate dispute regarding the enforceability of a use restriction. Obtained a monetary judgment in favor of oil company. See BP Products North America Inc. v. Haidar Van Dyke, LLC, 408 F. Supp. 2d 323 (E.D. Mich. 2005).

Defended oil company against claims brought under contract and the Petroleum Marketing Practices Act. Obtained summary judgment in federal district court, which was affirmed by the Sixth Circuit. See Dedvukaj v. Equilon Enterprises, LLC, 301 F. Supp. 2d 664 (E.D. Mich. 2004), affirmed, 132 Fed. Appx. 582 (6th Cir. 2005).

Represented lender in case involving a question of first impression under Michigan's Consumer Protection Act. Federal district court issued first published decision finding lender exempt under the Michigan Consumer Protection Act. Summary judgment in favor of lender was affirmed by Sixth Circuit. See Mills v. EquiCredit Corp., 294 F. Supp. 2d 903 (E.D. Mich. 2003); 344 F. Sup. 2d 1071 (E.D. Mich. 2004); affirmed 2006 WL 455158 (6th Cir. 2006).

Defended lender in case involving claims under the Truth in Lending Act and Bankruptcy Code. Obtained dismissal of case in federal district court, which was affirmed by Sixth Circuit. See Worthy v. World Wide Financial Services, Inc., et al., 347 F. Supp. 2d 502 (E.D. Mich. 2004); affirmed, 2006 WL 2188931 (6th Cir. 2006).

Defended lender against claims of fraud and usury concerning a loan transaction. Obtained summary judgment for lender. See Hanning v. Homecomings Financial Network, Inc., 436 F. Supp. 2d 865 (W.D. Mich. 2006).

Represented clients in a variety of patent disputes involving multi-function fax machines, optical disc technology, and fixture gauges.

Represented a variety of large and small companies and shareholders in matters concerning business combinations, shareholder rights, derivative actions, and contests for control.
