Mr. Semaya has practiced law since 1981. He has broad experience representing and counseling clients based in and outside of the United States in the litigation, arbitration and mediation of business disputes in areas such as international distribution, licensing and sales agreements, transaction financing and payment arrangements, contract and construction claims, claims arising from acquisitions, and business torts such as unfair competition, interference with contract and breach of fiduciary duty. Other areas of experience include securities fraud, attorneys’ and accountants’ professional liability, and insurance coverage. Mr. Semaya also advises clients on legal risk management in international transactions and operations, and has conducted confidential internal corporate investigations. Representative experience includes representation of a Middle Eastern bank in multiple proceedings in the United States and foreign jurisdictions to recover funds seized in international enforcement action; a Latin American distributor in breach of contract action against U.S.-based multinationals; a U.S.-based multinational in a wrongful termination claim by a Middle Eastern distributor; a European software publisher in an unfair competition claim by a database supplier, a Big Five accounting firm in a 10b-5/RICO claim on an IPO, and conduct of a confidential investigation for a United States subsidiary of a large Asian multinational technology company. Mr. Semaya is a Co-Chair of the International Litigation Committee of the Commercial and Federal Litigation Section of the New York State Bar Association, and a member of the Section’s Executive Committee. He has organized continuing legal education programs on international litigation and arbitration subjects for bar association and other groups, and has spoken before attorneys admitted in both United States and non-United States jurisdictions. In 1980, Mr. Semaya received his Juris Doctor degree, with honors, from the National Law Center, George Washington University, in Washington, D.C., where he was a member of the George Washington Law Review, and, in 1977, he received his Bachelor of Arts degree, cum laude, from the University of Rochester in Rochester, New York. He is a member of the bars of the State of New York, the District of Columbia, the U.S. Court of Appeals for the Second Circuit and the U.S. District Courts for the Southern, Eastern and Northern Districts of New York. Mr. Semaya is also a member of the Association of the Bar of the City of New York, the District of Columbia Bar Association, and the American Bar Association (Sections on International Law and Litigation). |
