Stephen Bernstein Biography :

Stephen W. Bernstein is a partner in the Health Law Department of McDermott Will & Emery LLP’s Boston office and chairs the Firm's HIPAA Practice Group and co-chairs the Firm's Health Transactions Group each on a nationwide basis. He specializes in e-health, deployment of electronic health record systems, health related matters impacted by the Internet, and HIPAA, as well as mergers, acquisitions, affiliations and joint ventures in the hospital and physician areas. Mr. Bernstein has particular experience working with regional electronic health record collaborations as well as pharmaceutical, biotech, device companies, health care providers and insurers concerning uses of health information for clinical and database research, product/disease registries and marketing matters, electronic health record development and implementation. In the transactional arena, Mr. Bernstein has extensive experience advising academic medical centers and hospitals, large, multi-specialty physician practice groups both within and outside of the tax-exempt sectors as well as venture capital/private equity firms and their health-related portfolio companies.

Mr. Bernstein is ranked in Chambers USA: America’s Leading Lawyers for Business, EuroMoney Legal Media Group’s US Healthcare Expert Guide, and The Best Lawyers in America (2007). He has also been named in Boston Magazine as one of Massachusetts’ Super Lawyers. Representative clients include: The Massachusetts eHealth Collaborative, the Massachusetts CPOE Initiative, Cardinal Health , Novartis Pharmaceuticals Corporation, Harvard University, IMS Health, Physicians’ Organization at Children’s Hospital, ChartOne, and Caritas Christi Health System and affiliates Caritas Christi Physician Network and Good Samaritan Medical Practice Corp.

Mr. Bernstein has practiced health law since 1988 in Boston, Massachusetts and in Palo Alto, California. In Palo Alto, he provided on-site counsel to Stanford University Medical Center. Among other accomplishments at Stanford, Mr. Bernstein negotiated the affiliation between Stanford Health Services and Lucile Salter Packard Children’s Hospital. He lectures extensively on health care privacy/HIPAA and related security issues, data mining, clinical research and product/disease registries as well as physician compensation, and electronic health record implementation, and has been featured on National Public Radio's syndicated program Here and Now and has been quoted by The Wall Street Journal and The Washington Post on medical privacy issues.

Mr. Bernstein is a member of the Massachusetts, District of Columbia and California bars, and received his A.B. magna cum laude from Duke University in 1985, and his J.D. degree cum laude from Boston College Law School in 1988, where he served on the Boston College Law Review and was the executive editor of the Annual Survey of Massachusetts Law. Mr. Bernstein chaired the Boston Bar Association's HIPAA/State Law Task Force's subcommittee on preemption, co-chairs the legal working group of the eHealth Vulnerability Reporting Program, a national program founded by major health plans that includes major health information software vendors with the goal of identifying and remediating security vulnerabilities in health care related software systems, and has been a member of the Massachusetts Medical Society's HIPAA speakers bureau. Mr. Bernstein is also a member of the American Health Lawyers Association and its Health Information Technology Committee, and has completed internships with the British National Health Service and the United States House of Representatives Subcommittee on Health and Long-Term Care.
