Seth Lloyd Biography :

Mr. Lloyd is a member of both the Health Care Practice Group, which he headed for many years until 2001, and the Employment Practice Group. As a health care lawyer, Mr. Lloyd serves as principal outside counsel to a number of Michigan hospitals and health systems. He is very experienced in health care mergers and acquisitions, governance matters, corporate reorganizations, joint ventures, exclusive contracts with hospital-based physician groups, and nonprofit tax matters. He regularly represents hospitals in medical staff matters, including contested medical staff disciplinary hearings, and in litigation arising from credentialing disputes. Mr. Lloyd is also an experienced trial lawyer, both in trial and appellate courts. He represents hospitals and health care systems in Civil False Claims Act investigations and litigation, in qui tam and whistleblower lawsuits, and in fraud and abuse matters. As an employment lawyer, he regularly represents hospitals, health care systems, and other employers in personnel matters and employment litigation in state and federal courts.

Mr. Lloyd lectures frequently on health care matters (such as qui tam complaints, compliance programs, medical staff hearings, and intermediate sanctions) and on employment matters (such as sex harassment issues, litigation avoidance, and the Americans with Disabilities Act). He has served on the faculty of a number of continuing education seminars (the Deposition Skills Seminar and the Trial Skills Seminar, both sponsored by the Institute for Continuing Legal Education). He has also written and lectured on how Sarbanes-Oxley might be applied to the governance of non-profit entities, and on qui tam lawsuits.

Mr. Lloyd is the Member in Charge of Professional Personnel for the law firm, and, in this capacity, is in charge of all firm associates and legal specialists.

Experience

He has handled on behalf of hospital clients many contested hearings requested by physicians under medical staff bylaws. The basis for the physicians' appeals include corrective action because of alcohol abuse, sexual harassment, disruptive behavior, and quality of care concerns.

He represented a hospital in dealing with the revocation of medical staff privileges of an employed physician who has been charged with criminal sexual conduct toward two nurses in the hospital.

He represented a hospital and its principal officers in an action brought by a physician whose group lost an exclusive, hospital-based physician contract with the hospital. The matter was settled favorably for the hospital and its officers.

He and another member of the firm were lead counsel in a Civil False Claims Act case in United States District Court brought against a hospital and two physician groups (which were separately represented) by a former employee alleging fraudulent billing. The District Court granted the hospital’s motion for summary judgment. Mr. Lloyd handled the appeal for the hospital in the United States Court of Appeals for the Sixth Circuit, which affirmed the lower court’s dismissal of the complaint, and the United States Supreme Court, which denied certiorari.

He was lead counsel representing a large radiology group in a trial in United States District Court. Plaintiff, a radiologist employed by the group, sued under the Americans with Disabilities Act claiming a failure to accommodate her disability. The jury returned a verdict of no cause of action and the matter was dismissed.

He represents a hospital in a Medicaid investigation of a hospital-employed physician who is under investigation for his E&M coding.

He has represented ambulatory surgery centers in appealing matters involving their Medicare certification date.

He represents, with another member of the firm, a hospital in a partially-unsealed qui tam lawsuit in United States District Court.
