Mr. Herbert is a shareholder in the Firm’s Tort Defense Group. He focuses his practice on commercial litigation, products liability, mass tort and medical malpractice defense. Mr. Herbert has extensive trial and appellate experience handling numerous complex litigation matters including high exposure product liability and medical malpractice defense, catastrophic injury and wrongful death claims Since joining LeClairRyan in 1998, Mr. Herbert has obtained 21 defense verdicts in 12 separate jurisdictions in Virginia. He has successfully defended high exposure wrongful death cases involving brain and cardiac surgery, permanent disability claims involving obstetrical (shoulder dystocia), gynecological and ophthalmic surgery and surgeries involving retained objects. Prior to joining LeClairRyan, Mr. Herbert defended automotive manufacturers in automotive crashworthiness matters. He also defended numerous retailers, distributors, and manufacturing concerns in contractual disputes, risk management issues, first and third party actions, discovery disputes, and declaratory judgment actions.
