Roger is a partner in the business litigation group of Faegre & Benson in London and co-chair of the firm's International Arbitration Group.
Roger is qualified as a Solicitor Advocate (All Higher Courts) and is authorised to exercise rights of audience in all courts in all proceedings.
Roger is a Fellow of the Chartered Institute of Arbitrators. Recent arbitrations have included engineering and technology claims on projects in India, Nigeria, the Middle East and the Baltic States. An accredited mediator since 1996, Roger is on the panel of mediators of the Federation Against Software Theft (FAST). Recent successful mediations in which he has been involved have related, for example, to warranty claims, professional negligence actions and distributorship agreements.
A member of the International Bar Association, Roger has been both a speaker and chairman at many legal conferences, including international dispute resolution conferences in New York, Geneva, Nice and the Hague. He has lectured and published articles on topics including Jurisdiction, Pre-Trial Protective Remedies, Enforcement of Foreign Judgments, International Dispute Resolution Provisions and Enforcement Issues and Archiving and Admissibility of Documents and Computer Records.
Roger's practice areas cover a broad range of commercial dispute work. This includes international arbitration, warranty claims, banking, shareholder and joint venture disputes, computer technology and engineering issues, fraud cases, tracing claims and asset freezing injunctions.
He has been involved in numerous cases which have been appealed to the Court of Appeal, the House of Lords and the European Court of Human Rights. Reported cases include: Dawnay, Day & Co Ltd v. de Braconnier and others (restrictive covenant in JV); Dawnay, Day International Ltd v. Cantor Fitzgerald (passing off); Banque Financière de la Cité (formerly Banque Kayser Uliman SA) v. Skandia/Westgate (remedies for breach of duty of utmost good faith by underwriters); Derby v. Weldon(worldwide Mareva injunction and development of ancillary orders); Tate Access Floors v. Boswell (privilege against self-incrimination in search and seize orders); Banque Financière de la Cité v. Parc (Battersea) Ltd (restitution); Teesside Power Holdings Ltd v Barclays Bank PLC.
