Roger Mead Biography :

Roger Mead is a litigation partner in FLK's San Francisco Office. He has extensive trial and appellate experience in complex commercial cases, including securities, trusts & estates and bankruptcy cases. He is admitted to practice in both California and New York, and has litigated in jurisdictions throughout the country. Mr. Mead first joined the firm as its sixth lawyer in 1980 after serving as law clerk to the Honorable Morris E. Lasker of the United States District Court for the Southern District of New York. He rejoined the firm in 1991 after an eight year sojourn in New York City, where he was a litigation partner in a prominent firm. Representative Matters Representing trustees of a $45 million testamentary trust in litigation involving complex trust interpretation and financial mismanagement claims, Mr. Mead obtained summary judgment fully vindicating the conduct of the trustees. Representing heirs in a dispute relating to the sale of a $45 million Picasso, Mr. Mead obtaining summary judgment dismissing all of the plaintiff's claims. Mr. Mead was retained shortly after a jury returned a verdict for $40 million, including $33 million in punitive damages, to handle post-trial motions, contempt proceedings, and the appeal. After several months of intense post-trial proceedings, including a bench trial on the contempt claim, the case was settled on terms favorable to Mr. Mead's client. Mr. Mead represented a renowned jewelry designer in breach of contract and fraud litigation arising out of a ten-year business relationship with a diamond wholesaler. Mr. Mead's client obtained a judgment for over $10 million in cash and credits following a bench trial in New York. Representing the former owners of a merged technology company in multiple bankruptcy proceedings, Mr. Mead assisted them in purchasing the portion of the business they previously owned from the bankruptcy trustee, defeating avoidance claims, and obtaining a dividend on distributions from the estates. Mr. Mead represented Lehman Brothers in a nationwide securities market manipulation class action. The matter was settled for less than one-half of the fees incurred by the plaintiffs' attorneys. Mr. Mead represented Coopers & Lybrand in a complex tax malpractice action favorably settled during opening statements to the jury. Mr. Mead represented members of the founding family in connection with Delaware Chapter 11 proceedings of Edison Brothers Stores, including plan confirmation and litigation related to a pre-bankruptcy asset spin-off. Mr. Mead successfully represented objectors to a class action settlement involving the "roll-up" of a publicly traded real estate limited partnership in proceedings in the Los Angeles County Superior Court and related proceedings in the United States Bankruptcy Court of the Southern District of New York. Mr. Mead represented the members of the Audit Committee of the Board of Informix Corporation in federal and state securities and derivative litigation and a related SEC investigation arising out of Informix's restatement of its earnings in 1997. Mr. Mead successfully represented Fluor Corporation in connection with a series of lawsuits relating to the development of an agricultural waste-fired power plant in Madera County, California, obtaining a multi-million dollar settlement before trial on claims against the construction lender and a favorable settlement during a jury trial against the project owners. Representing Lifetime Corporation, a large provider of home health care services, and its officers and directors, in federal securities and RICO litigation in the Eastern District of Pennsylvania and the Third Circuit Court of Appeals, Mr. Mead obtained summary judgment for his clients on all claims.
