Robert J. Feinberg

Mr. Feinberg focuses his practice on complex business and real estate litigation, the representation of corporations, shareholders and executive employees, estate/probate/fiduciary disputes, corporate litigation avoidance and risk management. Robert appears before the majority of New Jersey's State and Federal courts and is frequently appointed by the judiciary as a R. 1: 40-12 Mediator. Designated by the New Jersey Supreme Court as a Certified Civil Trial Attorney, Mr. Feinberg has achieved a distinction limited to approximately 2% of New Jersey lawyers.
As counsel to the business community, Mr. Feinberg represents partners, shareholders, and members in Director and Officer claims, corporate divorces, tortious interference and unfair competition actions, business fraud and conflict of interest disputes involving attorneys and fiduciaries and professional liability claims. He counsels his clients in matters involving issues of piercing the corporate veil, consumer fraud claims, defamation actions, and law suits involving breaches of representations, warranties and indemnification demands. Robert litigates contract claims of all types and prosecutes and defends restraining orders and other equitable remedies in the Chancery courts. His litigation avoidance and risk management practice includes pre/post transaction advice to public companies, venture capitalists and private equity firms and problem solving strategies for deal makers, entrepreneurs, corporations and professional service and law firms; serving his corporate clientelè as outside General Counsel.
In the real estate arena, Mr. Feinberg represents public and closely held developers, tenants, REITS, brokers, management companies and individuals. Robert counsels his real estate clientelè in matters involving courtroom advocacy, appellate issues, association disputes, commission claims, fraud, construction and contract disputes, and aids development goals through the maze of governmental and competitive obstacles. He represents title insurance companies and policy holders in claims involving title defects, boundary disputes, encroachments and restriction enforcement and relief. Redevelopment litigation, specific performance claims and restrictive covenant enforcement and abandonment cases are also routinely handled by Mr. Feinberg as designated trial counsel.
Mr. Feinberg's probate and estate practice includes counsel to dispossessed heirs, financial institutions, executors, corporate fiduciaries, banks and attorneys in will and trust contests, commission disputes, fiduciary removal and reinstatement and accounting actions. He has been lead trial counsel in estate disputes that exceed $100 million dollars and is relied upon by the investment community for his expertise in harmonizing legal solutions with business driven goals. Robert is often called upon by attorneys involved in probable intent disputes to serve as trial counsel and provides guidance to the investment community with respect to trust and estate compliance issues.
