Rick Knuth Biography :

Doing my clients' work is a privilege. It’s easy to find able and experienced lawyers, but good lawyers who also give a high level of service are scarce. I strive to be a good lawyer who also gives good service.

Rick L. Knuth concentrates his practice in the areas of water rights, real property law, real estate development (both commercial/retail and residential), commercial finance and leasing, and bankruptcy/creditors' rights. He advises clients in the acquisition, sale and collateralization of water rights and in administrative proceedings before the Utah State Engineer. He is past chairman of the Water Law Committee of the Utah State Bar and has written and lectured widely on water rights matters. He leads Jones Waldo’s Water Law practice group and is a member of the Firm’s Board of Directors.

Rick is a Fellow of the American College of Mortgage Attorneys, a peer-nominated group of lawyers from each state who are highly skilled and experienced in the preparation of real estate mortgages, lending transactions secured by real estate, and related practice. There are only 400 fellows nation-wide, five of which practice in Utah, including Rick (www.acmaatty.org). He was also named one of Utah’s Legal Elite by Utah Business Magazine in 2006-2008.

Rick also has extensive experience in Article 9 loans, foreclosure and disposition of equipment, inventory, farm products and accounts receivable. He has a broad background in commercial bankruptcy and work-outs, having represented creditors, debtors and committees and having served as a bankruptcy trustee himself. He has assisted local government borrowers and public lenders in publicly-financed, revenue-secured loan transactions and has documented and has closed numerous residential and commercial developments and leasehold transactions.

Rick’s clients include commercial banks, mortgage companies, credit unions, private lenders and borrowers in asset-based loan transactions, and inventory-based financing, as well as institutional, governmental and private lenders in judicial and non-judicial foreclosures of apartment complexes, large commercial, industrial, and residential properties.

Rick received his B.A. from Weber State College in 1974, and his J.D. from the University of Utah in 1980. He is an Associate Member of the Urban Land Institute. He received an "AV" Rating from Martindale-Hubbell. Rick is the past chairman of the Utah State Board of Mandatory Continuing Legal Education and currently serves on the Diocesan Council of the Episcopal Diocese of Utah, the Salt Lake City Housing Trust Fund Advisory Board and the Board of Trustees of the S.J. Quinney College of Law at the University of Utah.

Representing a commercial bank in a judicial foreclosure of its security interest in water rights.

Representing a mortgage company in litigation over stream-of-payments sale.

Representing a motor fuel retailer in asset-based development loans exceeding $100 million.

Representing a flooring lender in an Article 9 foreclosure of retail inventory and accounts receivable.

Assisting a public borrower in revenue bond-secured loan for municipal water system development.

Assisting an owner-developer of a research and development campus in its acquisition of water rights.

Advising a residential real estate developer in administrative proceedings before Utah State Engineer in its application for approval of a change in water use from agricultural to domestic.

Representing litigants in water easement, forfeiture, general determination and quiet title litigation.

Negotiating and drafting retail and shopping center leases, cross-easement agreements, subordination and non-disturbance agreements, indemnity agreements, leases, ground leases, deeds of trust, mortgages, security agreements and collateral assignments, assignments of rents, and ancillary documents.

Representing the buyer of a regional shopping center in a syndicated purchase-money loan transaction.

Representing the lead lender in mediation of its dispute with loan participants in an asset-based syndicated loan.

Non-judicial and judicial foreclosures on behalf of a national bank in its capacity as trustee for holders of commercial mortgage-backed securities, backed by apartment complexes and office buildings.

Review of loan documents and issuance of attorney opinion letters to secured lenders.

Represented commercial bank in troubled loan workouts with equipment lessees.
