Richard Rogers Biography :

Richard B. Rogers is a partner in the law firm of McDermott Will & Emery LLP, resident in its Washington, D.C. office, where he is a member of McDermott's Trial Department, focusing on civil litigation in both state and federal trial and appellate courts. He regularly acts as both lead and local counsel before state and federal courts in the Commonwealth of Virginia, assists in McDermott's appellate practice in cases throughout the country, counsels clients on insurance coverage matters, and participates in litigation involving insurance coverage, patents, copyrights, trademarks, tax issues, and other matters.

During law school, he served as Research Editor of the Duke Law Journal. He is admitted to practice in Virginia and the District of Columbia, as well as before the U.S. Supreme Court, the U.S. Courts of Appeals for the Fourth, Sixth, and Federal Circuits, and the U.S. District Courts for the Eastern and Western Districts of Virginia.

Representative Experience

Obtained a favorable summary judgment ruling from the Eastern District of Virginia for a client accused of fraud by a customer who purchased the company's computerized system for burning plates used in commercial printing applications only to experience difficulty in using the plates with his particular printing presses.

Assisted in successful litigation to obtain an injunction for a client preventing the State of Colorado from enforcing an unconstitutional product labeling rule that, unlike rules enforced by every other state in the Union, prohibited sellers of insect repellent from including true claims regarding the safety of their products on the labels.

Assisted in the briefing process in the Federal Circuit in a case where a team of McDermott attorneys obtained a favorable ruling that a patent cannot be declared unenforceable solely on the basis of alleged litigation misconduct.

Assisted in the briefing process in a groundbreaking Sixth Circuit case involving the interpretation of the Digital Millennium Copyright Act in which the court ruled that where an authentication process was required to use a laser printer toner cartridge, but did not restrict access to the actual program code, the McDermott client's marketing of a competing product containing a microchip that mimicked the authentication process was not a copyright violation under the DMCA.

Assisted in the administrative appeal of an FDA order withdrawing a client's animal drug following the first animal drug withdrawal case that the FDA had litigated since 1985.
