Raphael Lupo Biography :

Raphael V. Lupo is a partner in the law firm of McDermott Will & Emery LLP based in the Washington, D.C. office. Ray concentrates his practice in the areas of patent, trademark, copyright and trade secrets litigation and associated counseling. He is highly rated in Chambers Global, Chambers USA, Lawdragon, Best Lawyers in America and was recognized by Super Lawyers as one of the Top 100 lawyers in Washington, D.C.

Ray has extensive trial and appellate experience in the federal courts and before the International Trade Commission. He has represented major U.S. and international corporations in various patent, trademark and copyright litigation disputes. Most of Ray's practice over the last two decades has concerned the representation of clients in complex technology areas including integrated circuits, microprocessors, computer-related technologies, and medical devices. Many of these cases involved multiple patents and multiple parties requiring extensive trial teams for the presentation of the case. In these cases, he has often served as the lead counsel.

Ray has considerable experience in presentation of appellate matters. He began his legal career as an associate solicitor before the United States Patent and Trademark Office in 1969. Since presenting his first appellate argument in that year, he has been counsel of record before the U.S. Court of Appeals for the Federal Circuit and its predecessor Court in over 100 appeals. He has been selected to lecture on the most important cases decided by the Federal Circuit on several occasions, including a presentation on the topic at the Court's judicial conference. On several occasions, he has given the "Year in Review" speech to the ABA Patent, Trademark and Copyright Section, American Intellectual Property Law Association and the Patent Examiners of the United States Patent and Trademark Office. He often is called upon to present appeals to the Federal Circuit from cases that have been handled by other law firms during trial. He has also taught patent enforcement at the George Washington University Law School.

Ray is a co-author of Patent Litigation and Strategy, a publication of the West Group. He is also a frequent lecturer before legal associations. Over the years, he has spoken on both discovery and trial techniques in intellectual property cases.

Ray counsels clients in developing and protecting intellectual property rights, including licensing strategies. He also advises clients on complex patent prosecution matters, reexamination, reissue and interferences before the U.S. Patent and Trademark Office.

Ray worked as a patent examiner in the U.S. Patent Office from 1964 to 1969. He was an associate solicitor in the U.S. Patent Office from 1969 to 1977 and was an acting member of the Board of Patent Interferences as well as the director of the patent planning staff. In 1977 he became the deputy assistant general counsel for patents at the Department of Energy, a position he held until he entered private practice in 1980.

Ray received a bachelor of science degree in electrical engineering. He received a Distinguished Service Award at the Department of Energy in 1979, was selected to the Best Lawyers of America in 1994 and has consistently been listed to date, and has been ranked as a leading lawyer in intellectual property in the United States by Chambers Global as well as a leading IP lawyer in the District of Columbia by Chambers USA (2004-2007).

He is a member of the bars of Virginia, the District of Columbia and the United States Supreme Court. He is admitted to practice before several federal courts including the U.S. Court of Appeals for the Federal Circuit, the District Court for the District of Columbia and the District Court for the Eastern District of Virginia.

Ray serves from time to time as a mediator, arbitrator and expert witness on patent law. In the latter activity, he has been accepted by eleven federal district courts as a recognized patent law expert and expert on Patent Office matters.

Ray was also active in organizing the first intellectual property based American Inn of Court in the United States. In 1995, he became the President of the Giles S. Rich American Inn of Court. He is also a former member of the Amicus Committee of the AIPLA and the Amicus Committee of the American Bar Association Patent, Trademark and Copyright Section.
