Description of Practice:

Randy is a partner in our Del Mar Heights office and is Chair of the Technology and Intellectual Property Practice Group. Randy’s practice emphasizes intellectual property, licensing, and commercial transactions for emerging growth companies in the biotechnology, Internet, telecommunications, computer, and software industries. Randy's areas of focus also include domain names, trademark and copyright registration and enforcement, Website protection, privacy regulations, and e-commerce.

In July 2006, Randy was named by the San Diego Transcript as a Top Attorney in the intellectual property transactions field. In May 2007 he was listed in California Super Lawyers as a leading practitioner in the intellectual property field.

A significant portion of Randy’s technology and intellectual property practice is international in nature. Since January 2004, Randy has represented U.S. clients in establishing their global sales and supply chain through licensees, agents, joint venturers, manufacturers, suppliers, and distributors in 42 international transactions with companies located in 27 foreign countries. He has also developed an extensive network of relationships with attorneys throughout the world that can provide local law compliance.

Before joining the Allen Matkins team, Randy acted as WebSideStory, Inc.’s Senior Vice President, General Counsel, Secretary, and Chief Privacy Officer, and as General Counsel and Director of Corporate Development at Directed Electronics, Inc. Immediately prior to joining WebSideStory, Randy was a Shareholder of Heller, Ehrman, White & McAuliffe, and had before then been a partner at Baker & McKenzie. When he entered private law practice in 1989, he had served as a legislative assistant on the staff of the U.S. House of Representatives for five years. While working for Congress, Randy authored the Anti-Terrorism Tax Act of 1986, IRC 901j.

His accomplishments with respect to trademarks include registering the color of Never Compromise golf clubs and the sound of the Viper car alarm siren. Regarding domain name disputes, he has successfully represented, among others, Swissair and tennis professional Serena Williams. Other trademark and copyright clients have included the authors of Jonathan Livingston Seagull and The One Minute Manager. Randy has also advised the estate of Princess Diana in connection with rights of publicity.

At WebSideStory, Randy was involved in the national privacy debate through his participation in the Online Privacy Alliance and the Network Advertising Initiative task force on web beacons, and he lobbied both the U.S. Congress and the California Legislature on Internet and technology related issues.

In early 1997 the San Diego County Superior Court appointed him to advise the court on intellectual property aspects in connection with the mass suicide of the Heaven’s Gate cult members.

Randy is a frequent lecturer and author on legal issues in the technology law field. His speaking engagements have included Internet World, the Directors Roundtable, the Licensing Executives’ Society, the Canadian and American Associations of Corporate Counsel, the International Trademark Association, and the Young Presidents’ Organization. His published articles have appeared in the National Law Journal, Digitrends, the Los Angeles Daily Journal, the San Diego Business Journal, IP Law & Business, IP Today, San Diego Daily Transcript, Privacy & Data Security Law Journal, and IP Frontline Magazine.

Fox News, National Public Radio, and CNBC have interviewed him on Internet-related topics. Diane Bell of the San Diego Union Tribune described him as one of San Diego’s intellectual property ‘big guns’ and the San Diego Transcript has described him as one of San Diego’s top intellectual property rainmakers. In 1995, Randy was profiled in the San Diego Business Journal. He has been quoted on technology law issues by the New York Times, USA Today, Fox News, PC Magazine, ABC News, Investor's Business Daily, ComputerWorld, Advertising Age, and the Wall Street Journal.

Since 1997, Randy has been an instructor of several technology and intellectual property courses at the University of California, San Diego. He has also guest lectured at the University of San Diego Business School and at the California State University, San Marcos.

Randy is a member of the State Bars of California, Texas, and the District of Columbia; the Intellectual Property Sections of the California State Bar and the American Bar Association; the Licensing Executives' Society; and the American Intellectual Property Law Association (AIPLA). He has served as Chair of the Enterprise Consortium and as Vice Chair of the Health Care Policy Council of San Diego.

Educational History:

Randy received his B.A., with distinction, Phi Beta Kappa, from Stanford University in 1983. While an undergraduate, he also served on the Editorial Board of the Stanford Daily. He received his J.D. from the University of Virginia School of Law in 1989, where he served as Senior Editor of the Journal of Law & Politics.
