Phyllis Flora Biography :

Phyllis Flora is an attorney at Dwyer & Collora concentrating her practice in health care and criminal law.

She provides representation for health care providers in criminal investigations and prosecutions, hospital-based peer review proceedings, investigations and prosecutions by Boards of Registration, and audits by Medicare, Medicaid and other third-party payors.

She has expertise in electronic discovery and technology issues, assisting clients and colleagues in forging the new world of electronic case management where technology touches nearly every aspect of legal practice.

Ms. Flora has been involved in litigation for over 13 years. Prior to joining Dwyer & Collora, LLP, in 1995, she served as a law clerk to the Justices of the Massachusetts Superior Court.

Areas of Representation:

Ms. Flora is experienced in broad-based health care litigation and white collar criminal defense practice. She represents a wide range of health care providers in licensing proceedings, criminal and civil investigations by the Massachusetts Attorney General’s Office and United State Attorney’s Office, peer review proceedings, and third-party payor audits. She has served as general counsel to a trade association of health care providers and lead counsel in a class action challenging Medicaid reimbursement rates.

Recent Cases:

Represented Fortune 500 pharmaceutical company in multi-year, multi-issue and parallel criminal and civil health care investigation by the U.S. Attorney’s Office in Boston, which resulted in civil resolution of all issues; neither the company nor any employees were charged with crimes.

Successfully sued the Commonwealth of Massachusetts, including its Division of Health Care Finance and Policy and its Division of Medical Assistance, on behalf of the Massachusetts Ambulance Association and individual member companies to obtain higher rates of reimbursement for ambulance and chair car services. As part of the settlement the companies not only received retroactive rate increases but the Commonwealth was also required to reimburse the Association for the legal fees expended in initiating and prosecuting the litigation.
