Philip Bentley Biography :

Philip Bentley is a partner in the international law firm of McDermott Will & Emery/Stanbrook LLP based in its Brussels office. He is a member of the Firm's EU regulatory practice and European Competition and Trade Groups. His practice focuses on EU anti-dumping, trade defense and customs, EU competition (including State aid and public procurement), EU regulatory matters, notably GMOs, and EU litigation.

With a history in EU trade law dating back to the 1970s, Philip was one of the original partners of this practice in Brussels.

He has substantial experience in representing Indian, Chinese and Malaysian exporters in EU anti-dumping and countervailing proceedings in areas ranging from polyester films and data storage media to castings and chemicals. As such he is listed in Who's Who Legal Trade & Customs 2008.

Philip is co-author of "Anti-Dumping and Countervailing Action - Limits Imposed by Economic and Legal Theory" (Elgar 2007). He is co-author of "Dumping and Subsidies", now in its third edition (Kluwer 1996) and is a contributor to Atkins Court Forms, Competition Volume (2003). His published articles include "Rejection of European Commission Proposals for Anti-Dumping Measures in an Enlarged European Union, International Trade Law & Regulation (July 2004).

Representative Experience

Representation of a Chinese exporter in a court challenge to anti-dumping duties on certain stationery products (pending).

Representation of an Indian exporter in repeated reviews of EU anti-dumping and countervailing duties in the plastics sector.

Assisting with successful court challenge to an Italian ban on the marketing of certain GM-derived products authorized at EU level.

Complaint on behalf of a trade union alleging illegal State aid in the maritime shipping sector and subsequent court challenge to Commission decision (pending).

Complaint to the European Commission alleging failure of a Member State to respect EU law on protection of confidential business information in the context of product authorization procedures.
