AREAS OF PRACTICE Litigation - General Real Estate Taxation Trusts and Estates Philip represents individuals in estate planning and the execution of health care and power of attorney documents, as well as inter vivos trusts where appropriate. His probate practice is centered primarily in the four Harris County probate courts, where he customarily represents independent executors. He has received a number of court appointments as attorney ad litem in heirship proceedings and will contests, and as temporary administrator of decedents' estates. He has handled probate proceedings in at least twelve other Texas counties. His appellate practice includes the successful defense of a constructive trust imposed on a convicted death row defendant's share of the estates of his parents, whom the defendant murdered along with other family members who were potential beneficiaries of the parents' estates. Philip works cooperatively with accounting firms in the preparation of federal estate tax returns and federal income tax returns of larger estates, and he has tried federal tax cases in the United States Tax Court and the United States Court of Federal Claims. REPRESENTATIVE EXPERIENCE Philip is the court-appointed attorney ad litem for the unknown heirs in a will construction suit involving a will drawn by an attorney for the decedent in which the attorney named himself as a beneficiary of the decedent's estate in violation of the State Bar of Texas Disciplinary Rules of Professional Conduct. This action by an attorney not related to the client by blood or marriage is now prohibited by an amendment to the Texas Probate Code passed after the date of the will in question. He is admitted to practice in the U.S. District Court for the Southern District of Texas, the U.S. Tax Court, the U.S. Court of Appeals for the Fifth Circuit, the U.S. Court of Federal Claims and the U.S. Court of Appeals for the Federal Circuit. Honorary degree of Doctor of Laws from St. Augustine's College, Raleigh, North Carolina 1994. Member Houston and American Bar Associations and State Bar of Texas. Honorary life member of American Institute of Certified Public Accountants. Fellow of American College of Trust and Estate Counsel, Texas Bar Foundation and Houston Bar Foundation.
