Peter Kinsella is a partner practicing technology law in Faegre & Benson's Denver office and was the first chair of the firm's intellectual property transaction practice. His practice is focused on advising start-up, emerging and large companies on intellectual property and technology related commercial transaction matters. Prior to joining the firm in 2000, Pete worked for ten years in various legal capacities with Qwest Communications International, Inc. (formerly U S WEST, Inc.) in Denver and Honeywell, Inc. in Minneapolis.
Pete offers extensive experience structuring and negotiating domestic and international agreements involving technology, including, software development and license agreements, joint development agreements, technology transfer agreements, consulting agreements, e-commerce agreements, web development and hosting agreements, data sharing agreements, complex procurement agreements, product distribution agreements, OEM agreements, marketing and advertising agreements, corporate sponsorship agreements, telecommunication hardware and services agreements and various types of patent, trademark and copyright licenses. Pete has also represented buyers and sellers in domestic and international mergers and acquisitions. The value of several of these transactions have exceeded one billion dollars.
As a registered Patent Attorney, Pete has extensive domestic and international patent expertise. With respect to patent issues, he regularly counsels clients regarding patent portfolio strategy and management issues, provides patentability, validity, and infringement analysis, and develops complex patent litigation and pre-litigation strategies. He has represented clients in a number of high-profile patent disputes, including several disputes that resulted in settlement payments exceeding $100 million dollars.
Pete also provides domestic and international trademark advice, including, trademark availability opinions, trademark conflict counseling, portfolio management advice and worldwide strategy development and counseling. While at U S WEST, Inc. he was responsible for managing over 1500 trademark applications and registrations in 62 countries and all trademark opposition and litigation proceedings.
