Peter A. Clark is a partner in the law firm of McDermott Will & Emery LLP based in the Firm’s Chicago office. As a part of the Corporate Department’s Restructuring & Insolvency Practice Group, Peter concentrates his practice primarily on restructuring troubled financial transactions, defaulted securities, creditors’ rights and general commercial litigation. He also specializes in sports law with emphasis on athlete representation, contract negotiation, licensing, marketing and endorsement.
National practice concentrating primarily on creditors’ rights, bankruptcy, lender liability, in and out-of-court restructurings involving troubled financial transactions, defaulted securities, public, institutional and private debt, and equity.
Extensive experience with troubled debt financing including the representation of indenture trustees, commercial banks, insurance companies, institutional investors, mutual funds and credit enhancers.
Experience in cross border finance, debt restructurings and M&A in multiple jurisdictions.
Creditor representation in healthcare credits involving nursing homes, assisted living centers, CCRC’s, hospitals and hospital systems.
Represent master and special servicers in REMIC and CDO based securitizations in both in and out-of-court settings.
Represent manufactures and suppliers to several Tier I and Tier II auto suppliers in bankruptcy matters.
Represent equity and portfolio companies in workouts, bankruptcies and wind downs.
Represent clients in asset acquisitions and divestitures via 363 sales and foreclosure.
Advise clients on corporate governance, fiduciary duty issues, and responsibility in connection with work outs, restructurings, bankruptcy and general commercial matters.
Sports practice including athlete representation of high profile professional athletes, teams, and sponsors in matters such as contract negotiations, litigation, commercial endorsements, trademark disputes, licensing and endorsement/marketing strategies. Peter has appeared in several motorsports trade publications on athlete representation.
Peter is a member of the bar for the Northern District of Illinois, Central District of Illinois and has appeared before several state and federal courts throughout the country in addition to the Seventh Circuit Court of Appeals.
Peter is admitted to practice in Illinois.
