Legislative and Regulatory Representation

Paul T. Clark is a partner in Seward & Kissel’s Washington D.C. office. Mr. Clark has practiced at the firm since 1984, and has been a partner since 1989. Mr. Clark specializes in banking and securities law matters, including related legislative and regulatory issues.

Since joining the firm, Mr. Clark has concentrated on emerging issues affecting the financial services industry, particularly as they relate to the banking activities of securities firms. He has represented one or more of the national securities firms on legislation intended to restructure the relationships within the financial services industry, including the Gramm-Leach-Bliley Act of 1999.

As a result of his work as lead legislative counsel on the 1991 law that regulates the brokering of deposits, and his representation of the securities industry in negotiating the FDIC regulations implementing the law, Mr. Clark is nationally recognized as an expert on brokered deposit products, including certificates of deposit and various deposit account "sweep" arrangements. He advises brokerage firms on regulatory compliance, program documentation and state law issues. He also works with the federal securities and banking regulators to obtain necessary interpretive guidance.

Mr. Clark was Legislative Assistant to Congressman Mark W. Hannaford in 1976 and 1977. He has served as counsel to the Securities Industry Association’s Brokered Deposit Committee and the National Commission on Saving and Investment in America.

Mr. Clark was an organizer of Bank 2000, N.A. and served as a member of its Board of Directors from 1985 – 1990. He has served on the California State Society’s Board of Directors, and was the Society’s President in 1986. He has been a member of the Board of Directors of the Washington Chamber Symphony and the National Advisory Committee of the National Museum of Women in the Arts. He has also served as President of the Berkeley Alumni Club of Washington, D.C.

Mr. Clark is co-author of "Regulation of Savings Association under the Financial Institutions Reform, Recovery, and Enforcement Act of 1989" (The Business Lawyer, May 1990) reprinted by Clark Boardman Callahan in FIRREA: Law and Practice.

Mr. Clark received his A.B. degree with High Honors from the University of California, Berkeley in 1976 and his J.D. degree from the University of California School of Law (Boalt Hall) in 1980. He is a member of the District of Columbia Bar and is listed in Who’s Who in American Law.
