Description of Practice:
Pamela Andes is a partner in the firm's Orange County office and is the head of the firm's Environmental Law Practice Group. She has worked on a broad range of environmental projects. Pam has served as counsel for companies in connection with the purchase, sale, development, leasing and financing of properties with contaminated soil and groundwater. She has also served as counsel on numerous matters involving contracting with and guiding the work of environmental consultants, litigation experts and public relations consultants, landlords in negotiating service station leases with major oil companies, as well as receivers of environmentally-impaired sites, including assisting receivers with court documentation facilitating the cleanup and negotiating the contracts with the remediation companies.
The following is a list of representative projects Pam has handled:
Negotiated numerous environmental indemnity, remediation and easement agreements and guaranties with Fortune 500 companies in connection with the purchase and sale of contaminated properties;
Represented purchasers of multi-million dollar contaminated properties in negotiations to obtain indemnification and remediation agreements from the seller and/or other responsible parties;
Represented potentially responsible parties in connection with remediation of contaminated properties;
Represented purchasers of contaminated properties in negotiations with governmental agencies in order to obtain Prospective Purchaser Agreements to protect the purchasers from environmental liability;
Represented purchasers of contaminated properties in negotiations with insurance companies in order to obtain environmental liability insurance policies;
Represented lenders on contaminated properties in negotiations with borrowers to obtain appropriate indemnification and remediation agreements and with insurance companies in order to obtain environmental liability insurance policies;
Represented potentially responsible parties (including the firm's role as joint defense counsel to five major oil company PRPs) at federal and state superfund sites, including providing advice regarding remedial investigations, feasibility studies, health risk assessments, remedial action plans and community relations activities;
Counsel on the impact of Federal and State environmental laws on companies' ongoing operations and practices;
Negotiated settlements of alleged statutory violations with various governmental agencies, including the South Coast Air Quality Management District, California Regional Water Quality Control Board and Orange County Health Care Agency; and
Counsel in defending potentially responsible parties in litigation involving Sections 106 and 107 of CERCLA and in connection with prosecution of CERCLA contribution actions for the clean-up of hazardous substances.
Educational History:
Ms. Andes graduated from the University of Southern California with a B.S. in business administration, magna cum laude, and received her J.D. from Loyola University of Los Angeles, where she graduated second in her class, magna cum laude, and a member of the Order of the Coif. |
