Ms. Rustomjee's general civil litigation practice emphasizes general business and employment disputes. She also has broad experience in prosecuting actions for bad faith denial of insurance coverage and violation of constitutional rights. In addition to her litigation practice, Ms. Rustomjee has a busy employment counseling practice. Because of her family background, Ms. Rustomjee represents a number of South Asian-owned businesses in the United States. General Business Litigation Ms. Rustomjee has broad experience in representing plaintiffs and defendants in high-stakes business litigation, including actions for breach of contract, violations of joint venture and franchise agreements, business torts, misrepresentation, unfair competition, and misappropriation of trade secrets and other violations of intellectual property rights. In addition, she has defended a property developer against claims for violation of the Endangered Species Act and other environmental laws. Employment - Ms. Rustomjee has defended almost every type of employment case. Her experience includes the defense of claims alleging sexual and racial harassment, sex, age, race and disability discrimination, ADA access violations, retaliation, wrongful termination, breach of contract, and unfair labor practices. Cognizant of the toll that protracted litigation exacts on the individuals and companies involved, Ms Rustomjee focuses on obtaining quick and fair resolutions wherever possible. In addition to her employment litigation practice, Ms. Rustomjee regularly counsels corporate officers, management and human resources personnel on a broad range of employment issues. She is also retained by individual executive and management-level employees to counsel them on employment issues, and has negotiated many severance packages and employment agreements. Insurance Coverage and Bad Faith Ms. Rustomjee is frequently retained by companies and high net-worth individuals involved in high-stakes litigation in order to review and analyze their insurance policies for the insurers' coverage and defense obligations, to tender and advocate for defense and indemnification, and, where necessary, to prosecute the insurers for breach of contract and bad faith failure to provide coverage and defense. Constitutional Challenges - Ms. Rustomjee has prosecuted actions vindicating the constitutional rights of companies and individuals. She has represented utility and cable company franchisees in related actions challenging the constitutionality of certain municipal ordinances.
