Nancy Reiner Biography :

Ms. Reiner has extensive experience in the area of complex commercial litigation in large, precedent setting cases. She possesses substantial expertise in general litigation areas as well as in insurance cases on behalf of policyholders, in tobacco, guns, mold, environmental and other public interest cases and in alternative dispute resolution, having been involved in the settlement of several multi-million dollar cases.

Ms. Reiner served as a Special Assistant Attorney General for the Commonwealth of Massachusetts in connection with its landmark suit against the United States tobacco industry. She also represented the states of New Hampshire, Maine and Rhode Island in their actions against the tobacco industry, all of which were settled as part of the $206 billion dollar settlement of November, 1998. She also represented the City of Boston and the Boston Public Health Commission in their suit against gun manufacturers.

Representative Matters

oDistrict of Columbia v. Heller. Co-authored amicus brief for U.S. Supreme Court on behalf of professors of criminology and in support of D.C.'s right to enact strict handgun ban.

o Mallik v. The Heritage Companies. Represented tenant in mold contamination personal injury case, resulting in successful settlement of case.

o Consumers for Dental Choice, Inc. v. Commissioner of Environmental Protection, CT. Represented non-profit plaintiff regarding application of mercury regulations on use of dental mercury amalgam by dental practitioners.

SWINC v. Lloyds, et al., Representing plaintiff in multi-million dollar insurance recovery case.

oCity of Boston v. Smith & Wesson, et al. Represented City in case against gun manufacturers for negligent distribution and breach of warranty issues. Resolved case in April, 2002.

o Commonwealth of Massachusetts v. Philip Morris, et al. As Special Assistant Attorney General, represented the Commonwealth in tobacco litigation for reimbursement of State Medicaid expenditures, resulting in $8.3 billion settlement. (Also represented RI, NH and ME in litigation and as part of $206 billion national settlement.)

o National Fuel Gas v. INA; Wausau Insurance Company; American Home Assurance Co.. Successfully settled multi-million-dollar lawsuit against insurers regarding storage of natural gas.

o Continental Casualty Co. et al. v. General Battery Corp. et al. Successfully resolved complex coverage cases of over $20 million with 15 separate insurance carriers covering more than 50 separate sites and over 20 years of insurance coverage.

o Polaroid Corporation v. The Travelers Indem., Co., 414 Mass. 747 (1993). Precedent-setting decision by the Supreme Judicial Court on carrier duty to defend; led to settlement with all major carriers for Polaroid and conclusion of six year fight (1987 - 1993) for insurance coverage on all Polaroid environmental claims.

o Dedham Water Co. v. Cumberland Farms. First private Superfund cost recovery action to go to trial in United States on behalf of water supply company.
