Morten Nissen is a partner in the international law firm of McDermott Will & Emery/Stanbrook LLP, based in its Brussels office. He is a member of the Firm’s European Competition Group, and his practice focuses primarily on advising private companies on matters including merger control, abuse of dominance and State aid. He also provides extensive advice on EU regulatory matters.
Morten has written numerous articles and spoken on competition law issues. He lectures frequently at the College of Europe’s Advanced Community Law Program.
Morten is a member of the Danish Bar and an associate member of the Brussels Bar.
Representative Experience
Obtaining clearance of a multitude of merger transactions both from the European Commission and national competition authorities
Representing a major European collecting society in an investigation by the European Commission in the CISAC case
Defending companies in cartel cases before the European Commission, including obtaining full immunity from fines under the EU and Mexican leniency rules for a major international company
Defending two major European collecting societies against a complaint before the European Commission alleging abuses of dominance and anticompetitive practices
Issuing a complaint with the European Commission for a Danish association on State aid and abuse of dominance issues in relation to railway traffic
Counseling a major producer of headsets and hearing aids on competition law issues
Counseling and representing a leading global producer of mobile telephones on competition law and merger control issues
Advising the major international music publishers on competition law cases before the European Commission, including obtaining a Commitment Decision in the Cannes Extension Agreement case
Counseling a major energy company on competition law aspects of exports of natural gas to and within the EU, including the applicability of EU and Energy Charter Treaty rules
Representing complainants in several cases before the European Commission concerning international payment cards, including Visa International NDR; Europay (Eurocard/MasterCard) and Visa International MIF
Advising an international air carrier on competition law aspects of its participation in one of the major airline alliances and certain non-EU overflight rights
Defending a major European telecommunications company against a complaint concerning abuse of dominance by one of its competitors
