Mark Davis Biography :

Mark G. Davis is a partner in the law firm of McDermott Will & Emery LLP based in the Washington, D.C. office. As a member of the Intellectual Property, Media & Technology Department, Mark heads the Firm’s International Trade Commission practice and has devoted his career to litigating intellectual property rights and related antitrust issues. He has been lead counsel in cases before the United States International Trade Commission and both district and appellate federal courts.

Mark’s litigation experience before the International Trade Commission includes representation of clients ranging from Fortune 500 corporations to start-up companies in more than 40 investigations. Mark’s representation of complainants in the ITC includes cases for Creative Technologies, Trend Micro and Linear Technology. For example, Mark represented Creative in their cases against Apple in which Creative obtained a settlement which included a 100 million dollar payment to Creative. He also represented Trend Micro against Fortinet in Certain Systems For Detecting Viruses Or Worms, 337-TA-510, where the Commission issued an exclusion order and cease and desist order after finding that all the accused devices infringed Trend Micro’s patent. Mark represented Linear Technology against Monolithic Power Systems in Certain Voltage Regulators, 337-TA-521, which the parties settled after agreeing to a consent order against all accused devices.

Mark’s representation of ITC respondents includes cases for Hitachi, Ltd. and Mosel Vitelic, Inc. He represented Hitachi against EMC in Certain Data Storage Systems, 337-TA-471, a case that settled after Hitachi filed its second sanctions motion against EMC. Mark represented Mosel Vitelic against Micron in Certain Semiconductor Memory Devices, 337-TA-414. That case settled after the administrative hearing in which the judge found that all of the patents asserted against Mosel Vitelic were invalid, not infringed, and unenforceable.

Mark also maintains an active appellate practice. Throughout his career, Mark has worked on over twenty appeals to the U.S. Court of Appeals for the Federal Circuit. Recent appellate actions include cases he successfully argued on behalf of Animatics Corporation and Fresenius, Inc.

In addition, Mark was an adjunct professor at the George Washington University Law School for many years where he taught patent enforcement. He has also written and spoken extensively on intellectual property and international trade related issues. Mark has been highly recognized as a leader in the field of International Trade: Intellectual Property (Section337) by Chambers Global 2008 as well as by Chambers USA in 2007. He has been recognized by Best Lawyers in America and PLC Which Lawyer? Yearbook as a leading lawyer in his field. Mark has also been repeatedly named among the top five percent of Intellectual Property Litigation lawyers in D.C. by Washington, D.C. Super Lawyers.

Mark is admitted to practice in the District of Columbia and before the U.S. Supreme Court, the U.S. Court of Appeals for the Federal Circuit, the U.S. Court of Appeals for the D.C. Circuit, the U.S. Court of Appeals for the Fourth Circuit and the U.S. District Court for the District of Columbia.
