Mark represents plaintiffs and defendants in: Antitrust litigation Contract disputes and related claims Trademark and copyright infringement actions Trade secrets disputes Insurance recovery disputes Franchise, dealer and sales representative litigation Telecommunications litigation and administrative proceedings Shareholder disputes Product liability litigation Representative Litigation Experience Antitrust: As co-lead counsel, obtained and protected on appeal summary judgment dismissing claim of antitrust conspiracy and variety of other claims involving ownership of television station [see 996 F.2d 1221 (Goins v. Lang)]; lead local counsel defending major pharmaceutical manufacturer against class action claims of antitrust conspiracy under Sherman Act Section 1 and antitrust laws of a number of states; as part of team acting as lead counsel, represented consumer class challenging effects of Northwest Airlines' merger with Republic Airlines under Section 7 of the Clayton Act [see 392 F.3d 265, 167 F.3d 439]; co-coordinating counsel for 26 pharmaceutical manufacturers defending class action lawsuits claiming violations of Minnesota antitrust laws; part of team representing feed mills and other indirect purchasers of vitamins in price-fixing claims against vitamin manufacturers in state court cases in Minnesota, Wisconsin and Iowa. Breach of contract: As lead counsel for major national bank, obtained summary judgment dismissing cross-claims for breach of contract, indemnity and negligence arising out of complex investment trust; as lead counsel, obtained and protected on appeal summary judgment in favor of payor of promissory note against claims that he still owed approximately $1.2 million because performance was untimely [see 176 F.3d 556]; as lead counsel, obtained temporary restraining order prohibiting termination of insurance issuing agent and successfully resolved dispute; as lead counsel for lessee of computer equipment that was sued for breach of lease, obtained settlement from lessor dismissing all claims against lessee and paying significant amount to settle lessee's counterclaim; as co-lead counsel, obtained successful settlement for life insurance company following favorable summary jury trial verdict on claims and cross-claims arising out of failure of computerized sales support system. Arbitration: As lead counsel, represented major pharmaceutical company in dispute with manufacturer arising out of FDA recall of prescription drug; lead counsel in variety of American Arbitration Association and National Association of Securities Dealers arbitrations; lead arbitrator on three-arbitrator panel determining whether manufacturer had right to terminate distributor. Product liability: As lead counsel, represented distributor of lubricants in trial of product liability claim and successfully settled case prior to conclusion of trial [see 899 F. Supp. 405]. Intellectual Property: As second chair, defended underground tank manufacturer against patent infringement claims and successfully settled case. Securities: As lead counsel, obtained temporary restraining order and injunction preventing National Association of Securities Dealers arbitration against financial services company based on claims of successor liability. Insurance recovery: As second chair, obtained jury verdict in favor of assignees of disability policy finding that anesthesiologist was disabled by mental conditions that caused him to sexually abuse patients, children and others [see 92 F. Supp. 2d 910]. Shareholder disputes: As lead counsel, obtained and protected on appeal summary judgment dismissing minority shareholder claims arising from a failed merger. ERISA: As second chair, obtained and protected on appeal a summary judgment in favor of ERISA trustee dismissing claims that trustee breached fiduciary duty by failing to inform employees that company had stopped making contributions [see 18 F.3d 630]. Mark counsels clients extensively on antitrust matters such as merger analysis and pricing restrictions and makes presentations to clients on antitrust issues and litigation avoidance. Mark also acts as outside general counsel for small but growing companies. Mark is former chair of the Minnesota State Bar Association's Antitrust Section and also former chair of Lindquist & Vennum's Antitrust, Franchise and Trade Regulation Practice Groups. Before joining Lindquist & Vennum, Mark practiced at Arnold & Porter in Washington, D.C. and was a law clerk for the Honorable Robert Coyle, U.S. District Court for the Eastern District of California. Mark is a member of the firm's Public Service Committee and maintains a consistent and varied pro bono practice.
