Margaret M. Duncan is a partner in the law firm of McDermott Will & Emery LLP based in the Chicago office. She is head of the Chicago Intellectual Property, Media & Technology Department and is a member of the Firm's Steering Committee. Peg focuses her practice on IP litigation, prosecution, counseling and transactions. In the patent area, she focuses on a wide variety of technologies.
Peg has been recognized by Chambers USA, The Legal 500 US, Leading Lawyers Network Magazine, and PLC Which Lawyer? as a leading lawyer in intellectual property. She has also been recognized by Law & Politics as an Illinois Super Lawyer, has been featured in Crain’s Chicago Business, and has been named a top lawyer in Illinois by LeadingLawyers.com.
Peg’s litigation experience includes patent, trademark, copyright, unfair competition, right of publicity, domain names and trade secret cases. Her experience also includes work as an in-house senior IP counsel for Amoco Corporation and Abbott Laboratories.
Peg received a bachelor’s degree in chemistry/biology. While in law school, Peg won first place in the Giles Sutherland Rich Moot Court Competition, Midwest Region, and was first runner-up in the national competition. Peg has been a speaker at several intellectual property conferences on topics ranging from use of expert witnesses in IP litigation, the Supreme Court's recent review of the obviousness standard for patentability, and intellectual property licensing.
Peg is a member of the bar of the State of Illinois and is admitted to practice before the U.S. District Courts for the Northern District of Illinois, Central District of Illinois and the Western District of Wisconsin, the U.S. Courts of Appeals for the Seventh Circuit and the Federal Circuit and is registered with the U.S. Patent and Trademark Office.
She is also admitted to the Trial Bar of the Northern District of Illinois, and is a member of the Federal Circuit Bar Association where she serves on the Patent Litigation Committee, the American Intellectual Property Law Association (AIPLA), International Trademark Association (INTA) and the Intellectual Property Law Association of Chicago (IPLAC).
