I enjoy working with clients to solve the complex environmental issues involved in buying or selling contaminated property .
Lucy B. Jenkins practices exclusively in the area of environmental law, focusing on business transactions involving environmentally impaired properties; redevelopment of Brownfields properties; remediation under state and federal environmental programs; voluntary cleanups; EPA and state administrative environmental enforcement actions; environmental permitting and compliance; environmental insurance; and toxic torts. She has dealt with environmental regulation of solid and hazardous waste, radioactive waste, underground storage tanks, water quality, wetlands, stormwater discharges, air quality and Superfund sites. Lucy is chair of Jones Waldo’s Environmental Law Practice Group.
Lucy represents industrial companies, national retail chains, real estate developers, banks, local governments, redevelopment agencies, sand and gravel companies, gasoline retail companies, truck stop companies, chemical distributors, dry cleaning companies, mining companies, universities, farmers and agriculture cooperatives.
Recent matters Lucy has handled include representing a national retail chain in the acquisition of a bulk fuel terminal for redevelopment as commercial property; representing a residential real estate developer in the acquisition of a historic mining property; advising a national retail chain with respect to acquiring a Brownfields property undergoing remediation of industrial contamination; defending a dry cleaning company charged with responsibility for cleanup of a contaminated groundwater Superfund site; representing a company applying for a radioactive waste disposal license; defending a sand and gravel operation charged with civil and criminal stormwater discharge violations; advising a national retail chain in acquiring wetlands conservation easements for off-site mitigation; and conducting environmental due diligence for acquisition of radio station transmission properties.
Lucy is chair of the Brownfields Development Committee of the Salt Lake Chamber of Commerce and has served as an officer and committee chair of the Environment, Energy and Natural Resources Section of the Utah State Bar. Lucy also serves on the Board of Habitat for Humanity.
Lucy was born in Savannah, Georgia in 1953 and grew up in upstate New York. She received a B.A. degree from the University of Colorado in 1974 and a J.D. degree from Brigham Young University in 1979. She served an energy law fellowship at the University of Utah College of Law from 1979 to 1980, and was admitted to practice by the Utah State Bar in 1980.
