Since joining Faegre & Benson in 1998, Kristin has litigated a wide variety of premises and products liability cases. At present, Kristin focuses her practice primarily on agribusiness litigation, which includes the defense of crop protection and seed products. Kristin has experience with the wide variety of federal and state laws governing agricultural trade and production, as well as an understanding of the rapidly-evolving genetic science that is transforming the industry. Agricultural Product Litigation Kristin provides national, regional and state level representation to crop protection chemical manufacturers and distributors, biotechnology companies, seed companies, and food and manufacturing companies. Some of her representative clients include BASF, DuPont, Syngenta Crop Protection, Inc. and Syngenta Seeds, Inc.Kristin counsels the firm’s crop protection chemical and seed clients on a variety of issues, including genetically modified organisms, product labeling and packaging issues and product liability prevention. In 2002, Kristin tried a crop damage case in Iowa before a jury, and obtained a defense verdict. The subsequent appeal was denied by the Iowa Court of Appeals. T.F. Ltd. v. American Cyanamid Co., 690 N.W.2d 463 (Iowa. App. 2004) (unpublished). From 2001-2004, Kristin served as defense counsel in crop damage litigation in Florida, comprising 15 separate cases. The litigation settled in March 2004, shortly after the client obtained a favorable FIFRA preemption ruling from the court. Most recently, Kristin obtained summary judgment for a client based on FIFRA preemption in the Central District of California. In addition to FIFRA preemption, Kristin has also briefed and argued a variety of legal issues arising in agribusiness litigation, including the economic loss doctrine and the enforceability of warranty disclaimers and limitations of remedy typically found on pesticide and seed products. Other Areas of Practice Kristin has litigated a variety of cases in addition to agribusiness cases, including Lanham Act violations, Section 1983 claims, and general commercial disputes. |
