Kirk Brett joined the firm in 2001 as chair of the Firm’s Bankruptcy Department. Mr. Brett has represented clients having a variety of positions, interests and goals in cases covering a wide spectrum of industries. As a result, Mr. Brett is equally skilled in representing clients in transactional matters as well as in litigation. Prior to joining the Firm in 2001, Mr. Brett practiced at Schulte Roth & Zabel, Donovan Leisure Newton & Irvine, and Rosenman & Colin, now known as Katten Muchin Rosenman. Mr. Brett has represented chapter 11 debtors and creditors’ committees in large and complex bankruptcy cases involving entities in the telecommunications, manufacturing, transportation, retail and real estate fields. Examples of some of his more prominent creditors’ committee cases include Rockefeller Center Properties, ETS Payphones, Alpha Tel-Com, Atlantic Express and Clark Material Handling Co., and examples of his chapter 11 debtor cases include Amnex, Inc. (including its subsidiaries) and the 300+ store retailer, Accessory Place. Mr. Brett has also represented other interested parties in bankruptcy cases and out-of-court workouts. For example, Mr. Brett represented the plan sponsor and acquirer of Integrated Resources, as well as prospective purchasers of retail leases and other assets in other large and mid-sized chapter 11 cases. Mr. Brett routinely advises venture capital and hedge funds, landlords, tenants, creditors, officers and directors in distress situations. In this capacity, Mr. Brett has been actively involved in some of the country’s largest and most complex bankruptcy cases, including Enron, WorldCom, AppliedTheory, Key3Media, NRG, Mirant and Solutia. Mr. Brett has investigated and litigated issues of fraud and fraudulent conveyance and a host of other bankruptcy and insolvency-related issues. Mr. Brett has also litigated commercial breach of contract, intellectual property, licensing, professional liability, and corporate governance disputes in a variety of federal and state courts. Mr. Brett is admitted to practice before all courts in the State of New York, the United States District Courts for the Southern and Eastern Districts of New York, and the United States Court of Appeals for the Second Circuit. |
