Professional Profile
Mr. Collins is head of the Firm´s Construction Practice Group and specializes in construction industry business litigation and transactions. He represents project owners, contractors, subcontractors, suppliers and design professionals in major transactions and litigation in connection with both public and private works of improvement. Mr. Collins has specific expertise in the prosecution and defense of construction claims involving competitive bidding, delays and disruption, inaccuracies and other deficiencies in plans and specifications, changed conditions, contract terminations, mechanic´s liens, public and private stop notices, public and private payment bond actions and enforcement of public and private performance bonds.
Mr. Collins´ representative litigation and transactional matters include:
Represented city in defense of $16 million claim by contractor arising from construction of new airport terminal. Achieved settlement in which city paid less than contract price and retained a portion of liquidated damages.
Represented international contractor in successful negotiation of $13 million additive change to EPC contract for modernization of hydroelectric pumped storage generating facility.
Represented project owner as part of trial team in 3-month jury trial of contractor´s $66 million claim arising from construction of major industrial processing facility in which contractor recovered less than half of amount claimed.
Represented general contractor in action arising from hotel modernization and expansion to recover $800,000 contract balance, extras and prompt payment penalties. Recovered entire amount sought, including attorneys´ fees.
Following legislative enactment of competitive bidding requirements, drafted public agency´s procurement policies and procedures for competitive bidding of construction contracts and solicitation of professional services.
Prepared contract documents for design and construction of major groundwater desalination plant.
Prepared standard form agreements for major telecommunications company for expansion of cellular telephone network.
