Description of Practice:
Kenneth W. Curtis is a litigation partner in the firm's Orange County office, specializing in the areas of public and private works construction, business and real estate. Mr. Curtis has enjoyed great success representing both plaintiffs and defendants in a broad array of litigation, from complex multi-party construction cases to relatively simple breach of contract actions. In his construction practice, Mr. Curtis assists clients in a wide variety of construction contract and project related issues including: bid responsiveness and responsibility; subcontracts and the subcontractor listing law; drafting and/or negotiating prime and subcontracts; minority and disadvantaged business participation; performance issues including compliance with specifications; time of performance provisions; critical path analysis (as related to responsibility for delay and delay damages); differing site conditions; rights to additional compensation as a result of changes, including impact damages; liability of principals and sureties on bid, performance and payment bonds; mechanic's liens and stop notices; right to recover on a total cost or modified total cost basis; right to recover reasonable value when a contract is abandoned or rescinded; and rights to terminate construction contracts for cause or convenience. Mr. Curtis represents clients in State and Federal Courts, and in private and public arbitration proceedings. He has also participated in numerous mediations, structured settlement negotiations, and other forms of Alternative Dispute Resolution.
A native of Orange County, Mr. Curtis is a member of the State Bar of California and the Orange County Bar Association. He is also a member of the Associated General Contractors of California (AGC), and serves on the AGC's Legal Advisory Committee.
Educational History:
Mr. Curtis obtained his Juris Doctor from Loyola Law School, Los Angeles, in 1988, where he also received the American Jurisprudence Award in Trial Advocacy. Mr. Curtis was a member of the Loyola of Los Angeles Law Review for two years and served as the Senior Note and Comment Editor in 1987-1988. In 1987, he published a Comment entitled "The Fiduciary Controversy: Injection Of Fiduciary Principles Into The Bank-Depositor And Bank-Borrower Relationships," 20 Loyola of Los Angeles Law Review 795 (1987). In 1985, Mr. Curtis received his Bachelor of Science degree in Business Administration from California State University at Long Beach. |
