José Rivas is a partner in the international law firm of McDermott Will & Emery/Stanbrook LLP. He is Head of the Brussels office and Co-Head of the Firm's European Competition group. His practice covers all aspects of EU law, in particular EU competition law (Articles 81 and 82, State aid and merger control) and public procurement.
José is recommended by IFLR1000 2007 and Chambers Europe 2007 ("the hire of José Rivas from Hammonds should also give the practice an added boost. He has extensive experience in representing leading U.S. and European clients in a broad range of industries, including media, telecommunications, energy and biotechnology.
José has extensive litigation experience before the European Courts in Luxembourg, having represented clients in competition, trade and institutional EU law. He has represented clients under investigation and obtained phase I and phase II merger control clearance by the European Commission and other national competition authorities, and has filed complaints with such authorities, achieving outstanding results.
José is editor of the World Competition, Law and Economics Journal (Kluwer) and has written extensively on competition law in both English and Spanish. He is a visiting Professor of Competition and State Aids Law at the College of Europe, Natolin Campus, and is a frequent speaker at conferences and seminars. He is also a member of the Working Groups on Competition and State Aids Law of the European Confederation of Business Associations (UNICE).
Representative Experience
Pleading two cases before the Grand Chamber of the European Court of Justice (2005).
Representing clients before the European Commission or in litigation before the European Courts in cartel cases involving cement, steel beams, self-copying paper, Belgian banks and Norwegian gas.
Representing clients in 2005 in one of the first Commitments Decisions under Article 9 of Regulation 1/2003.
Representing clients in merger control cases before the European Commission and Spanish authorities, including counseling of a third party producer of electricity in the largest deal in Europe (2005).
Advising major music publishers in relation to competition aspects of individual and collective copyright licensing.
Acting in State aid cases for recipients, complainants and awarding authorities, including litigation before the European Courts.
