Experience:

Mr. Roberti's practice focuses on complex antitrust litigation and counseling. Mr. Roberti represents clients in federal court and before the Federal Trade Commission and the United States Department of Justice's Antitrust Division. In addition to his litigation practice, Mr. Roberti counsels clients on a wide variety of antitrust issues, including mergers and potential transactions, intellectual property licensing and joint ventures.

Prior to joining Mayer Brown LLP in 2006, Mr. Roberti worked as an attorney with the Federal Trade Commission's Bureau of Competition. While at the FTC, Mr. Roberti managed investigations and litigations at all stages, including playing major roles in two significant trials. Mr. Roberti tried In Re PolyGram Holding, Inc., FTC Docket No. 9298, which established the mode of analysis that the FTC undertakes in examining joint venture agreements among competitors. Mr. Roberti's team won before the Administrative Law Judge in this matter, and the result was affirmed both by the full Commission and by the D.C. Circuit.

Mr. Roberti also played a key role in the trial in In Re Union Oil Company of California ("Unocal"), FTC Docket No. 9305. The Unocal case involved a public standard setting effort, and established the FTC precedent that there is a misrepresentation exception to Noerr-Pennington immunity under certain circumstances. After a 14-week trial, the case was settled when Unocal agreed to dedicate its accused patents to the public.

In addition, Mr. Roberti has worked on virtually all facets of FTC enforcement, including identifying cases and leading investigations. Mr. Roberti's FTC investigations involved, among others, the computer, real estate, household moving, media, and sports and entertainment industries.

Mr. Roberti regularly speaks and writes on key antitrust issues, and serves as the Vice-Chair of the ABA Antitrust Section's Committee on Exemptions and Immunities. Some of Mr. Roberti's representative matters at Mayer Brown LLP include the following:

Representing United Air Lines, Inc. and its affiliates in criminal grand jury investigations and in three separate multi-district civil litigation proceedings.

Advising our client Dobson Communications Corporation in its merger into AT&T, Inc., including obtaining clearance from the U.S. Department of Justice.

Defending a lawsuit on behalf of UnitedHealthcare affiliates alleging an illegal boycott of a Kansas spine and specialty hospital. (D. Kan. Case No. 05-CV-2164).

Advising our client SchwarzPharma regarding the sale of the drug Fesoterodine to Pfizer Inc. After an initial inquiry, the FTC chose not to issue a Second Request and the deal was consummated.

Counseling major pharmaceutical companies with respect to antitrust issues regarding the settlement of patent lawsuits, authorized generics and pricing policies.

Advising clients with respect to joint ventures and the licensing of intellectual property.
