John T. Cusack is a commercial litigation partner and a member of the Antitrust Team. John's practice spans 45 years and places him among the most highly regarded litigators in the United States.
John counsels clients in regard to an understanding of, and compliance with, state and all federal criminal and civil antitrust laws, and with other state and federal criminal and civil statutes affecting business executives. Specifically, he has counseled clients on all aspects of communications between competitors and their possible consequences under the antitrust laws; in regard to market exclusion practices and proposals and their possible consequences under the antitrust laws; in regard to mergers, acquisitions, unfriendly takeovers and joint ventures and Premerger Notification and second requests by the U.S. Department of Justice, Antitrust Division, and the Federal Trade Commission; in regard to Antitrust Division investigations, Civil Investigative Demands and grand jury investigations; in regard to all aspects of distribution and franchise practices, including compliance with the Robinson-Patman Act and with federal and state distribution, consumer protection, franchise and dealer protection laws; and in regard to possible unfair trade and consumer fraud practices both under federal and state laws. John also has extensive experience in general litigation cases, including contract, tortious interference and lender liability and bankruptcy cases.
John has been lead trial counsel for a party or parties in major criminal and civil cases tried in Chicago and Benton, Illinois; Indianapolis, Evansville and Hammond, Indiana; Milwaukee, Wisconsin; San Diego and San Francisco, California; Cheyenne, Wyoming; Miami, Tampa and Orlando, Florida; Boston, Massachusetts; New York, New York; Anchorage, Alaska and Seattle and Tacoma, Washington; Wilmington, North Carolina and Baltimore, Maryland. He has argued appeals in the Illinois Supreme and Appellate Courts, the U.S. Supreme Court and the U.S. Courts of Appeals for the 7th, 9th and 5th Circuits.
John is listed in the latest and previous editions of Who’s Who in America and Who’s Who in American Law and is also listed in Leading Lawyers in the Leading Lawyers Network of Commercial Litigators recognized by their peers in a statewide survey among the top lawyers in Illinois. He is listed in "Illinois Super Lawyers 2006" for antitrust litigation.

John received his bachelor's degree, cum laude, from the University of Notre Dame in 1957 and his J.D. degree from the University of Michigan Law School in 1960. John attended Harvard University Graduate School of Business Administration from 1961 to 1962, leaving to join the U.S. Department of Justice as a trial attorney for the Antitrust Division, where he served until 1970 when he joined the firm. |
