Joel L. Michaels is the partner-in-charge of the Health Department in McDermott Will & Emery LLP's Washington, D.C. office. He has extensive experience in health care insurance and health care delivery system organization, financing and regulation. He has assisted clients in obtaining state and federal licenses, contracts and approvals and developing viable organizational and contractual arrangements including, transactions involving the sale of stock, merger or transfer of assets. Joel also counsels payor clients on a wide variety of federal law issues, including Medicare and Medicaid regulation (including Parts C and D), the False Claims Act, the Federal Anti-Kickback Statute, ERISA, and the Health Insurance Portability and Accountability Act (HIPAA). He has worked with health plans and other payors on pharmacy benefit management contracts and related regulatory issues, including Medicare Part D, Medicaid and commercial arrangements. Joel also works with clients on complex litigation matters in the health insurance industry, including payment and claims processing disputes between health plans and providers. His familiarity with a wide variety of state health insurance and federal laws that impact provider/health plan relationships is a critical component of the advice he provides clients.
Joel has provided legal counsel to health maintenance organizations, health insurers, pharmacy benefit managers, national health care associations, employer purchasers, and third party administrators.
Joel is a member of the American Health Lawyers Association ("AHLA") where he has served on its Board of Directors and chaired its HMOs and Health Plans Substantive Interest Law Committee. He is a recipient of that organization's David J. Greenburg Service Award for his many outstanding contributions to the AHLA. He is also an AHLA "Fellow," which includes a select group of senior health law practitioners whose longstanding contributions to the AHLA are recognized through this designation. He also serves as a speaker and lecturer before national trade and professional associations and is widely published in the field of health care law. Joel has consistently been recognized over the last 10 years in health care in The Best Lawyers in America, and recently received the top lawyer's rating in health care from Chambers USA.
Joel is a member of the District of Columbia and Maryland bars. He currently serves as an adjunct member of the American University, Washington College of Law school faculty and teaches courses on managed health law issues.
