Joel E. Cohen is a partner in the law firm of McDermott Will & Emery LLP based in the Firm’s New York office and co-heads its U.S. Employment practice. Joel began his career as a trial attorney with the National Labor Relations Board. In the 2006 edition of Chambers USA: America’s Leading Lawyers for Business, Joel was recognized as a leader in the area of employment.
As partner in the Labor and Employment Practice Group, Joel practices exclusively in the representation of management in employment law litigation and counseling. His experience includes work on employment discrimination lawsuits and administrative proceedings, National Labor Relations Board (NLRB) matters, unionization campaigns, collective bargaining and employment contracts. He represents clients in the manufacturing, service and health care industries.
Joel is a frequent speaker on employment law topics, including union issues and sexual harassment. He is a contributing editor for NLRA Law and Practice, first published by Matthew Bender in 1992. He is one of 26 management labor lawyers in the entire nation who serve on an Advisory panel to the National Labor Relations Board. Joel was appointed to this Panel by former NLRB Chairman William Gould. He is a member of the bars of the State of New York, the U.S. District Courts for the Southern and Eastern Districts of New York and the U.S. Courts of Appeal for the Second and Seventh Circuits.
While in law school, Joel was a member of the Fordham Urban Law Journal.
Representative Experience
Won eight jury trials in employment cases involving race, age, national origin and disability discrimination, whistle-blowing claims and employment fraud for clients such as Union Carbide, Travelers Insurance, Reader’s Digest, Pitney Bowes and Memorial Sloan-Kettering Cancer Center.
Won victories in litigation before the National Labor Relations Board on behalf of clients such as St. Barnabas Hospital, Tenet HealthCare, Pitney Bowes and Kimble Glass Inc.
Successfully advised major corporations and banks in corporate restructurings and downsizings.
Successfully represented companies in non-compete and non-solicitation litigation.
