Jill E. Cooper’s practice spans the areas of environmental law, administrative law, climate change, sustainability and energy. Jill joined Faegre & Benson after serving five years as the senior advisor to the executive director of the Colorado Department of Public Health and Environment. Before that, she was the legal administrator to the Air Pollution Control Division. In these roles, she provided counsel on environmental, regulatory and policy matters, with a particular emphasis on emerging energy, climate change and sustainability programs and issues in Colorado and throughout the United States. Jill worked closely with a number of state-level environmental regulatory agencies through the Environmental Council of States, the U.S. Environmental Protection Agency (regional and headquarters offices), and local and national non-governmental organizations such as the Mayor’s Greenprint Denver, Colorado Environmental Partnership, Governor’s Pollution Prevention Advisory Group, Colorado Alliance for Environmental Education, United Nations Environment Programme, and the Multi-state Working Group.Her specific experience included: Regulatory Rulemaking efforts and statutory negotiations in the environmental arena, including air quality, water quality, asbestos and waste Settlement of hundreds of regulatory environmental enforcement agreements, including negotiation of supplemental environmental projects Represented the state of Colorado in cross media policy, statutory, regulatory and voluntary programs at an international, national and regional level Involved in national efforts regarding environmental regulations of the agriculture sector Designed, developed and initiated an environmental management system permit program and completed EMS auditing training Managed Colorado self-audit program and provided industry guidanceParticipation in developing Colorado’s Stormwater Excellence Program for the construction industry Represented the state in sustainability forums globally and provided guidance to industry, universities and not-for-profits on sustainability Energy Rule makings and regulatory initiatives impacting the oil and gas industry, including environmental (air, water and waste) and social impacts and factors Permitting, regulatory, and statutory work related to energy, including power generation, renewable energy and oil and gas development Represented state in BLM negotiations, development of state environmental legislation and regulations and in national dialogue regarding energy development Promoted and assessed statutory and regulatory requirements for renewable energy, including biofuels Permitting and regulatory work for utilities, natural gas, landfill gas recovery and methane recovery at swine operations Drafted and promoted enhanced incentives for the development of renewable energy at a national, state and local level Climate Extensive participation in local, state, regional, national and international climate change and greenhouse gas programs and efforts Negotiated and drafted contractual provisions to preserve clients’ potential greenhouse and other environmental benefits Advised companies on preparation for risk, cost and benefits associated with climate change and greenhouse gases Negotiated operational flexibility and incentives for compliance requirements Air Quality Negotiated and drafted PSD, Title V, synthetic minor and minor permits for air quality sources in multiple states Developed regulations and guidance for NSR, PSD, MACT, NSPS, NESHAP and other air quality regulations Managed state cross media agriculture program including air quality and odor requirements Provided legal counsel on statutory, regulatory and permitting requirements for many sectors, including oil and gas, utilities, agriculture, manufacturing, commercial, hospitals, small businesses, electronics, mining and minerals, renewable energy and construction Water Quality Participation in rule makings regarding stormwater, discharge permit programs, groundwater and other water quality programs Provided legal counsel on statutory, regulatory and permitting requirements to numerous sectors, including mining and minerals, oil and gas, renewable energy, agriculture, manufacturing, construction, aerospace and hospitals Represented the state agency in national negotiations for incentives and flexibility for regulated facilities Managed state cross media agriculture program.
