Jeffrey Levinger Biography :

Mr. Levinger is a partner at Carrington Coleman and the head of the Firm's appellate practice group. He has a business litigation practice in both federal and state courts with a particular emphasis on appellate litigation. Mr. Levinger has handled appeals for corporations, professional organizations, and individuals in numerous state appellate courts, the Texas Supreme Court, the U.S. Court of Appeals for the Fifth Circuit, other federal circuits, and the U.S. Supreme Court. His cases have presented a wide range of challenging questions, including state and federal procedure, antitrust, breach of contract, securities and common law fraud, corporate and partnership law, lender liability, bankruptcy and insolvency, professional malpractice, insurance, products liability, deceptive trade practices, officer and director liability, civil rights, noncompetition covenants, misappropriation of trade secrets, wrongful termination, and employment discrimination. Although many of Mr. Levinger's appeals have been from cases he or others at the Firm handled at the trial level, he is also frequently retained to handle appeals in cases in which the Firm was not involved at the trial level. In recent years, trial counsel with contingent fee interests in substantial judgments have engaged Mr. Levinger to seek to protect their clients' judgments on appeal. These cases involve a wide variety of substantive and procedural issues, and are in both federal and state courts. Mr. Levinger also writes amicus curiae briefs and consults with other counsel in connection with their briefs and preparation for oral argument. Given his particular ability to bring clarity out of confusion, Mr. Levinger is also frequently called upon by trial lawyers from both inside and outside the Firm to assist with complex legal issues at the trial level. This work includes drafting or responding to motions to dismiss or for summary judgment, preparing trial briefs on difficult legal or evidentiary issues, filing or opposing disqualification or recusal motions, handling mandamus actions or interlocutory appeals pending trial, preparing the jury charge and handling the charge conference, assisting at trial in preserving or avoiding appellate complaints, and providing representation in all aspects of the post-verdict process. Mr. Levinger handles these matters for both plaintiffs and defendants in complex commercial and personal injury lawsuits. In May 2005, Mr. Levinger succeeded in obtaining the reversal of a death sentence of a Texas death row inmate whom he and the Firm had been representing since 1990. The case required three evidentiary hearings, and went to the Texas Court of Criminal Appeals twice, the Fifth Circuit once, and the U.S. Supreme Court three times. Mr. Levinger was licensed to practice in Texas in 1982, and has been admitted to practice in the Texas Supreme Court, the U.S. District Courts for the Northern, Southern, Eastern, and Western Districts of Texas, the U.S. Courts of Appeals for the Fifth, Sixth, Tenth, and Eleventh Circuits, and the U.S. Supreme Court. Mr. Levinger was named by D Magazine as one of the "Best Lawyers in Dallas" in appellate law for 2001, 2003, 2005, and 2007 and has been recognized by Texas Monthly magazine as a "Super Lawyer" in appellate law each year since that award began in 2003. Mr. Levinger is board certified in Civil Appellate Law by the Texas Board of Legal Specialization.
