Jared handles complex commercial litigation, particularly in energy related matters. He joined the firm in 1992, representing both plaintiffs and defendants in Maine’s state and federal courts and before the Federal Energy Regulatory Commission ("FERC"). Since 2001, Jared has served as trial counsel in four multi-million dollar commercial disputes. These included a complex breach of contract dispute in Bankruptcy Court in Delaware in which the Firm's client obtained over $60 million in damages and a $4 billion challenge to a series of long-term energy contracts on behalf of the State of California before the FERC, the appeal of which was recently decided in the State's favor by the Ninth Circuit (Public Utilities Commission of California v. FERC, Docket No. 03-74207). In 2004-05, Jared served as lead counsel for the State of California in a proceeding before the FERC concerning the impact of the proposed implementation of locational marginal pricing in California's electricity markets on certain so-called "seller's choice" long-term energy purchase and sale agreements. Most recently, Jared has served as lead litigation counsel for the State with respect to Calpine Corporation's efforts to reject certain long-term energy contracts as part of its on-going bankrupcty. In addition to his litigation expertise, Jared has significant experience in the arbitration and mediation of commercial disputes and in conducting internal corporate investigations. He also counsels insurance companies and insureds on coverage matters, and he regularly appears before the Maine Bureau of Insurance on behalf of insurance companies. In September 1998, Jared was appointed Associate Independent Counsel for the Office of Independent Counsel, Ralph I. Lancaster, Jr., to investigate allegations that Labor Secretary Alexis M. Herman had engaged in influence-peddling and the solicitation of illegal campaign contributions. Practicing before a federal grand jury in Washington, D.C., he served in this position throughout the Independent Counsel's investigation. More recently, he has again teamed with Ralph I. Lancaster, Jr. to conduct a review of Maine's juvenile corrections facilities at the request of Maine's Governor. |
