Litigation Experience
Wide range of experience in all aspects of general litigation; emphasis on real estate litigation.
Represented venture capitalist limited liability company in suit arising from defendant's refusal to acknowledge existence of purchase agreement to sell property to client. Prepared opposition to defendant's motion for summary judgment. Participated in two month trial. Prepared Request for Statement of Decision.
Represented design engineer in construction litigation case.
Filed numerous unlawful detainer actions on behalf of commercial landlord entities.
Defended District Attorney and District Attorney's Investigator in federal court against various federal claims (Section 1983 claims related to alleged violations of First, Fourth and Fifth Amendments) and state claims (false arrest, false imprisonment, malicious prosecution, fraud, libel). Prepared and prevailed on two extensive motions for summary judgment.
Represented plaintiff individual in federal court against large corporation refusing to pay benefits under the corporation's plan after individual became disabled during time of employment.
Assisted tenant health care organization in defending against landlord claim of failure to maintain property in good repair, and claim that tenant had obligation to rebuild structure.
Represented contractor/owner in lawsuit involving subcontractors and suppliers who were responsible for extensive damage to project.
Assisted in defending deceased attorney's estate against claims by former partners of entitlement to share of large contingency fee awarded.
Defended physician against claims of elder abuse and medical malpractice arising from emergency amputation of patient's leg due to complications while recovering from hip surgery. Prepared motion for summary judgment and took lead in extensive law and motion practice.
Defended kindergarten teacher and school district against claims of negligence and premises liability after child attending school-sponsored party at teacher's house was discovered unconscious in teacher's pool. Prepared motion for summary judgment. Prepared writ of mandate to California Court of Appeals regarding superior court judge's refusal to apply statutory immunity for accidents occurring during school field trips.
Represented county in suit against neighboring county arising from dispute under a revenue sharing agreement over allocation of property taxes under statutory scheme.
Represented county in contract dispute with city over city's refusal to provide contracted services unless county agreed not to resist future annexation of portions of county land. Prepared extensive mediation brief.
Brought suit on behalf of steel erector subcontractor to recover money owed him by contractor and property owner for work on project.
Represented corporation in suit against consultant who engaged in activities requiring a realtor's license under California law.
Assisted in representation of clients in virtually all facts of pre-trial civil litigation, including pleadings, discovery, motion practice, mediation and negotiations.
Extensive motion practice including making and/or opposing demurrers, ex parte applications, motions to compel, motions for summary judgment and adjudication, and writs of mandate; deposed witnesses and defended numerous depositions.
Transactional Real Estate Experience
Prepared, negotiated, and reviewed tenant-oriented leases and lease amendments, licenses, and easements for major wireless telephone company.
Prepared landlord-oriented leases for retail shopping center on behalf of large California real estate developer.
Prepared landlord-oriented form lease for large California real estate developer to be used in development of major shopping center.
Prepared office subleases, including sublease for 10,800 feet of office space on behalf of landlord.
Prepared purchase and sale agreements and amendments on behalf of Buyer and Seller, both improved and unimproved property; prepared amendments to purchase and sale agreements.
Assisted in closings for purchases of improved and unimproved land.
Title review: Analyzed title exceptions for purpose of assessing risk associated with commercial real estate purchases; worked with title company to remove exceptions from title report; analyzed compliance with zoning requirements.
Negotiated and prepared numerous retail and office leases and lease amendments, both landlord-oriented and tenant-oriented.
Prepared mining lease.
Prepared numerous estoppel certificates and subordination agreements.
