In her wide-ranging environmental law practice, Helen Silver advises clients on a variety of regulatory matters. Her work in environmental compliance includes advising clients on such statutes as Chapter 21E, federal Superfund law, the Massachusetts Environmental Policy Act, and the Clean Water Act. Helen has particular experience with wetlands permitting issues, both in securing permits and defending permit appeals.

Helen also is actively involved in environmental controversies counseling. She represents clients in disputes over the responsibility for clean up costs and property damage related to contaminated property. Her work also includes the representation of public clients in eminent domain litigation, including the impact of environmental regulatory controls on taken properties. In addition, Helen has been involved in international and multi-state litigation in water-related disputes. For example, using her fluent Spanish skills, Helen actively participates in the representation of the Government of Uruguay in the International Court of Justice.

Prior to joining Foley Hoag LLP, Helen practiced in the Tort Litigation and Environmental Practice Group of another national law firm.

Representative Experience

The following is a brief summary of Helen's experience and accomplishments:

Coauthored an amicus curiae brief to the Supreme Court of the United States in Norfolk Southern Railway Company v. James N. Kirby Party Ltd., 125 S. Ct. 385 (position taken prevailed)

Obtained federal and state wetlands permits for a large recreational facility, including development of habitat conservation and education plans related to compliance with the federal Endangered Species Act

Participated in the successful representation of the Government of Uruguay in proceedings before the International Court of Justice in Pulp Mills on the River Uruguay (Argentina v. Uruguay)

Assessed environmental conditions of properties nationwide for large scale acquisitions by a major cellular telephone company

Represented an Atlanta-area municipal commission in the defense of litigation in multiple districts involving tri-state water dispute
