Fay Morisseau Biography :

Fay E. Morisseau is the partner-in-charge of the Orange County and Houston offices in the law firm of McDermott Will & Emery LLP. He is a member of the Intellectual Property, Media & Technology Department and has extensive trial experience in intellectual property and business litigation. Fay’s experience includes the representation of some of the leading U.S. companies in litigation arising from technology, intellectual property and business matters.

Throughout his career, Fay has worked on a wide variety of litigation matters relating to patents, trademarks, copyrights, business and product liability. His practice has recently emphasized patent infringement and business litigation. Fay joined McDermott Will & Emery in 1998.

Prior to becoming a lawyer, Fay worked as a petroleum engineer for Shell Oil Company. He received a bachelor’s degree in petroleum engineering.

Fay is a member of the state bars of California and Texas, and is registered with the U. S. Patent and Trademark Office.

Representative Experience:

Over the past several years, Fay has been involved in a number of major cases involving a variety of subject matters. The following is a brief list of some of the major cases in which he has been involved in recent years.

Lead trial attorney in a patent infringement case filed on behalf of a client in the Eastern District of Texas. The case was tried to a jury which rendered a verdict in favor of the client on all issues and awarded the client a multimillion dollar damage award.

Lead trial attorney defending a client in a significant patent infringement case filed in the Eastern District of Texas. Obtained a judgment before trial in favor of the client completely disposing of the case.

Lead lawyer in a month-long jury trial in state court in Houston, Texas involving ownership and infringement of patents, as well as breach of contract. The jury rendered a verdict for his client, and a judgment was entered for his client in excess of $11,000,000.

Lead lawyer in a four-week jury trial in a patent infringement case in San Jose, California. The jury rendered a verdict for his client, and subsequently the court entered a judgment for his client for treble damages and attorney fees.

Lead lawyer representing a patentee in a patent infringement case tried to a jury in a three-week trial in San Francisco, California. The jury rendered a verdict for his client and found the infringement to be willful. The court enhanced the damages and awarded attorney fees, resulting in a multi-million dollar judgment.

Lead lawyer in a Tampa, Florida case in which allegations were made that the use of a cellular telephone caused brain cancer. This was the first case of this nature filed in the U.S. The case received national attention and was featured on 20/20, The Larry King Show, Good Morning America, and numerous other U.S. newscasts. In May 1995, summary judgment on the merits of the claim was entered in favor of Fay’s client. The court held that there was no proof that the use of the cellular phone caused cancer.

Lead lawyer in a products liability case tried in Long Beach, California, in which he defended claims made against his client that his client’s product was defective, and the defect in the product caused over several million dollars in damages. The case was tried to a jury and lasted four weeks. The jury returned a verdict in favor of his client, finding that there was no defect in the product.

In addition to these cases, Fay, for the past five years, has been lead trial attorney for numerous high technology 500 Companies in patent infringement cases in California, Texas, North Carolina, Delaware, New York, Illinois, and Idaho.
