Eric Hargan Biography :

Eric D. Hargan is a partner in the law firm of McDermott Will & Emery LLP based in its Chicago office. Eric is a member of the Health Law Department.

Prior to joining McDermott, Eric served as the Acting Deputy Secretary of the U.S. Department of Health and Human Services. He also served as Regulatory Policy Officer of the Department, overseeing the development and approval of all HHS regulations and significant guidances. At HHS, Eric oversaw all operations, including Medicare, Medicaid, the regulation of food, drugs and medical devices, public health, welfare programs, medical research and other activities. While at the Department, Eric led a number of initiatives, including implementing the President’s Management Agenda, combating bio-terrorism and public health emergency preparedness. He was also the recipient of the Secretary’s Award for Distinguished Service. From 2005 to 2007, Eric served as Principal Associate Deputy Secretary of HHS, and from 2003 to 2005, he served the Department as Deputy General Counsel.

Prior to joining the Administration, Eric was a partner in a large international law firm in Chicago where he specialized in corporate law, particularly mergers and acquisitions, securities and venture capital transactions. Eric has significant experience in other areas, including cross-border transactions, public finance and institutional lending.

Mr. Hargan’s corporate experience has included large, complex transactions, such as: representing Motorola, Inc. in the 26-country reorganization and recapitalization of its Semiconductor Components Group; Rodamco North America N.V. in its acquisition of Urban Shopping Centers, Inc.; Monsanto Company in an issuance of $4.2 billion in debt and other securities; Prime Group Realty Trust in its initial public offering; White Hen Pantry in its sale to Clark Retail Group; General Electric Capital Corporation in acquisitions of several large loan portfolios; and Prime Retail, Inc. in its merger with Horizon Group Properties.

He has also represented clients in venture capital and start-up circumstances, both new companies and investors, including representing Chicago Climate Exchange in its formation and launch and Motorola, Inc. in start-up investment.

Mr. Hargan has spoken widely and been published both in the U.S. and overseas on health-related topics, including Medicare and Medicaid reform, health law, food safety, vaccines, quarantine, public health preparedness and pandemic influenza. He was a member of the U.S. government team at the inaugural U.S.-China Strategic Economic Dialogue in Beijing; worked with the Ministry of Health of Japan on food safety and importation issues; worked with the State Department’s Bureau of Arms Control to further biosecurity in developing nations; served as a member of the HHS Global Health Policy Core Group; and initiated and led the Departmental group that developed the first responses to international food safety and importation issues in 2007. He has chaired or served on numerous domestic and international health groups and committees, including serving as: co-chair of the U.S.-Australia Medicines Working Group; co-chair of the U.S.-Ireland R & D Steering Group; a U.S. representative at the World Health Organization; and as a member of the conference planning committee for the American Society of Law, Medicine and Ethics. He is a member of the American Health Lawyers Association.

While at Columbia University School of Law, Eric was a Senior Editor of the Columbia Law Review.
