Mr. Hosp has a broad range of experience in class action litigation in state and Federal courts, fraud and bad faith litigation, campaign finance law and government affairs. From 1999 to 2003, Mr. Hosp served as Legal Advisor to the Governor of Alabama. Since 2003, Mr. Hosp has served as an adjunct professor at the University of Alabama School of Law in Tuscaloosa. Before joining Maynard, Cooper & Gale Mr. Hosp served as a law clerk to the Honorable Harold Albritton, United States District Judge for the Middle District of Alabama from 1994-1995. From 1989 to 1991, Mr. Hosp served on the staff of the United States Senate Committee on the Judiciary. Mr. Hosp currently serves as the Chair of the Alabama Access to Justice Commission, which was established by the Alabama Supreme Court in 2007. Recent Representative Cases and Results: Successfully opposed class certification in putative nationwide class action regarding employment benefits. 2006 WL 2480071, M.D.Ala., August 25, 2006 (No. 2:05-CV-528-MEF.) As counsel for major life insurance company, received summary judgment in vanishing premiums litigation. 907 So. 2d 419 (Ala. 2005). Represented a major State University System in the successful conclusion of a more than two-decade old desegregation class action lawsuit. Served as counsel for major property and casualty insurer in a series of more than fifty (50) claims and lawsuits alleging fraud and bad faith. Ultimately negotiated terms favorable to the insurer securing releases from all claimants. Successfully represented major property and casualty insurer in fraud and contract based class action in Alabama State Court (class allegation voluntarily dismissed July 2007). Currently representing major property and casualty insurer in statewide class action lawsuits pending in Barbour and Bullock Counties alleging fraud and bad faith. Currently representing Alabama’s largest health insurer/payor in several class action lawsuits pending in federal and state courts in Alabama and Florida. Currently serves as counsel to county government in connection with efforts to reform the civil service system in terminating existing consent decree.
