Douglas Poland Biography :

Douglas M. Poland is a shareholder in the Litigation Practice Group in the Madison office. Doug has significant experience in class action, mass tort and other commercial litigation matters in state and federal courts in Wisconsin, Illinois, California, Colorado, Indiana, Kentucky, Maryland, Michigan, Missouri, New Hampshire, New Jersey, New York, Pennsylvania, Texas, and Washington. Doug's practice focuses on defense of complex litigation, with emphasis on products liability, toxic tort, and consumer fraud lawsuits. Doug also frequently counsels clients on regulatory and pre-litigation issues. Doug is a plenary member of the Health Physics Society and has participated in the defense of seven class-action and mass-action lawsuits brought against the operators of nuclear facilities for alleged physical injuries and property damage caused by environmental and occupational exposures to hazardous materials. He also is a member of the American Bar Association Section of Litigation, Product Liability Committee and of the DRI Toxic Tort and Environmental Law Committee. Before joining the Firm, Doug was a partner in the Litigation Practice Group at the Chicago office of Kirkland & Ellis LLP. Doug received his law degree from Loyola University Chicago School of Law, where he graduated summa cum laude and was the Lead Articles Editor of the Loyola Law Journal. He graduated with honors from Northwestern University with a bachelor's degree in history. Doug is a member of the bars of the Wisconsin Supreme Court, Illinois Supreme Court, United States Court of Appeals for the Seventh Circuit, United States District Courts for the Eastern and Western Districts of Wisconsin, Northern District of Illinois, Eastern District of Michigan, and District of Colorado.

Representative matters in which Doug has served as counsel or co-counsel for one or more defendants include the following:

Product Liability/Consumer Fraud

Tomberlin v. Adolph Coors, et al. Class-action lawsuit filed in Dane County Circuit Court. The plaintiff sought to certify a class of all parents of minors who purchased alcoholic beverages between 1982 and the present, alleging claims for violation of Wisconsin's Deceptive Trade Practices Act, unjust enrichment, negligence per se, negligence, and public nuisance, and seeks to recover compensatory damages, statutory damages, punitive damages, and injunctive relief. The complaint was dismissed and the case is on appeal. Frances Young v. Eli Lilly, et al. Pharmaceutical product liability action brought in Milwaukee County Circuit Court alleging personal injuries from ingestion of prescription medication. The case was successfully removed to federal court and transferred to multidistrict litigation, where it is ongoing.

State of Wisconsin v. Philip Morris, et al. Dispute in Dane County Circuit Court between state of Wisconsin and Original Participating Manufacturers of cigarettes over payments due under Master Settlement Agreement. The Original Participating Manufacturers successfully sought to compel arbitration of the dispute. Zwiercan v. General Motors Corp. Class-action lawsuit alleging a design defect in vehicles manufactured between 1990 and 1999. The plaintiff sought to certify a state-wide class of more than 500,000 vehicle owners and to recover $5,000 per class member. Seven of eight causes of action were dismissed on dispositive motions, and the trial court denied plaintiff's motion to certify a class of claimants under the eighth cause of action for the alleged violation of Pennsylvania's Unfair Trade Practices and Consumer Protection Law. No. 9906-3235, slip op. (Phila. Ct. Common Pleas Oct. 4, 2004) Frank, et al. v. DaimlerChrysler Corp., et al. Class-action lawsuit alleging a design defect in vehicles manufactured between 1990 and 1999. The plaintiffs sought to certify a state-wide class of more than 1,000,000 vehicle owners and to recover $5,000 per class member. The trial court granted the defendants' joint motion to dismiss, which was affirmed on appeal. 292 A.D. 118, 741 N.Y.S.2d 9 (N.Y. App. Div.), appeal denied, 99 N.Y.2d 502, 782 N.Y.2d 567 (N.Y. 2002). Green, et al. v. General Motors Corp., et al. Class-action lawsuit alleging a design defect in vehicles manufactured between 1990 and 1999. The plaintiffs sought to certify a state-wide class of more than 500,000 vehicle owners and to recover $5,000 per class member. The trial court granted the defendants' joint summary judgment motion, which was affirmed on appeal. Green v. General Motors Corp., 2003 WL 21730592, slip op. (N.J. App. Div. July 10), certification denied, 178 N.J. 32, 834 A.2d 405 (N.J. 2003).

Toxic Tort

June, et al. v. Union Carbide Corp., et al. Mass-action lawsuit brought by Colorado residents alleging personal injury arising from alleged releases of hazardous substances from uranium mill. The district court granted the defendants' summary judgment motion.

Cook, et al. v. Rockwell Int'l Corp. Class-action lawsuit pleading claims for property damage and medical monitoring brought by class of Colorado residents, who alleged exposure to plutonium released from nuclear facility. The case was tried to a jury in 2006. Post-trial motions are pending.
