Dennis Terrell Biography :

A. Dennis Terrell is a partner and past vice chairman of the business and finance department of the firm. Over the past thirty years, he has represented major creditors and financial institutions, Chapter 11 debtors, Chapter 11 trustees, Chapter 11 creditor committees, indentured trustees, bondholder committees and Section 1114 retiree committees, most recently in the following cases: Eastern Airlines, International American Homes, Inc., Immedica, Inc., Kaplan Organization, Maxide Acquisition Corp. (DMX Music), Prins Recycling Corp., et al., The Regina Company, Trico USA, Inc., Mutual Benefit Overseas, Inc., Herman's Sporting Goods, Braniff Airlines, Crazy Eddie, The Grand Union Company, Kmart Corporation, Pan American Airways and Trans World Airlines.

He is a certified civil trial lawyer by the New Jersey Supreme Court and has tried numerous commercial, business, real estate and bankruptcy cases in state, federal and bankruptcy courts.

He argued the often cited bankruptcy/environmental regulation case of Quanta Resources before the United States Supreme Court.

He represented the Chapter 11 trustee in the Robert E. Brennan case where millions of dollars of resecreted assets were located and returned to the bankruptcy estate to be distributed by the SEC and State of New Jersey to defrauded investors and is representing the Section 1114 Bethlehem Retirees' Committee where millions of dollars of lost medical benefits have been returned to the retirees.

In addition, Dennis has represented major landlords of commercial real estate in the Ames Department Stores, Exodus Communications, Skyview Media Group, Schwinn Bicycle and Able Laboratories Chapter 11 cases.

Over the past several years, Dennis has been instrumental in developing new preference programs for debtors and liquidating trustees to minimize costs to the estate while maximizing value to creditors. This preference program has been successfully utilized in the Twin County, Velocita and Impower bankruptcy proceedings and currently in the DMX/Maxide Chapter 11 proceeding.

Speaking Engagements and Publications. Dennis lectured at the 21st Annual Bankruptcy & Restructuring Conference of the Association of Insolvency and Restructuring Advisors in 2005 in Boston. He presented labor issues, including employee benefits (health and pension), KERPS, Warn Act and dealings with the Department of Labor. In 1996, Dennis lectured at the New Jersey State Bar Association Bankruptcy Law Section's Bench/Bar Conference on the Fair Foreclosure Act. He has lectured at ICLE seminars on attorney liability under the UFTA in 2005 and 2006 and before the New Jersey Bar Association on liability of collecting banks for checks drawn on insufficient funds. Dennis also lectured at the ICLE Bankruptcy Seminar on equitable subordination and at the New Jersey Bankruptcy Bench/Bar Conference on fraudulent conveyances.

Dennis has authored a number of articles on bankruptcy matters, most recently, an article in the Seton Hall Law Review entitled, "Caveat Lender: The Midlantic Decision and Its Progeny," an article in the Journal of Bankruptcy Law and Practice entitled "Issues in Taxation" and an article in the Bankruptcy Law Review, Volume 1, No. 2, entitled "How to Deal With Environmentally Contaminated Property in the Bankruptcy Estate."

In General. Dennis is a graduate of Hamilton College, receiving his bachelor's degree in 1964, and the University of Pennsylvania Law School, receiving his LLB degree in 1967. He was admitted to the practice in New Jersey in 1967 and New York in 1982. He is a member of the United States District Court for the District of New Jersey and the Southern District of New York, the Second and Third Circuit Court of Appeals and the United States Supreme Court.
